My Dad left the country initially on a trip to visit relatives, but then due to health issues decided to stay and get his treatment there instead of coming back to the states. He did not apply for the I-131 before leaving since, it was not his intention to stay out of the country for longer than 6months. He is planning on coming back, but will need to return for further treatment. He will be traveling to Mexico before heading to the states to meet with a specialist, and then will be entering the US through Tijuana. Will he have any problems entering? He has letters from his Doctor stating he was receiving treatment. Is there anything else we should prepare for? We know he will have to file the 1-131 before leaving again.
We were told he needs to file the SB-1 form. He is pretty careless, and since many of his friends have not had issues in the past he thinks he won't as well. He has had to move up his trip due to the specialists schedule in Mexico and will now be traveling to Mexico in a week, not enough time to file and get the form approved for him to enter the US. He wants to take the opportunity to visit me and my sisters, since he will be so close, but I do not want him to risk getting his green card taken away. He is entering through Tijuana, will they not let him through and take away his green card? What happens in these cases. How do they know that he has been out of the country for longer than a year?
