Does anyone has the same experience of leaving USA for a year after submitted application for 7th year H-1B extensions? My situation is that I have to leave the country for personal reason (tentative 12/04). I should leave the country before my 6 years H-1B expired (02/05), but my company had submitted the application for 7th year extension (10/04) based on LC pending more than 365 days. The 7th yr H-1B hasn't been approved yet since we are doing the normal processing, it should take about 4-6 months. I would like to know if I can get a fresh new 6 years H1/H4 after being 1 year abroad. Is there any chance the embassy will reject my VISA application because I have previously applied for immigration status?
