My F1 visa stamp on my passport expired Jan 12, 1999 (i finished my school on december, 1999)
i received OPT on Feb 14, 2000.. am i out of status thoses dates between Jan 12, 1999 to Feb 14, 2000?

I heard about 30 days rule.. but i was wondering..
does 30 days rule start when you finish school or when your F1 visa stamp expired?

Thank you..

You do not go out of status simply because your F1 visa stamp expired, as long as you were a full time student. You could be out of status after graduation, depending on when you graduated, when you applied for the OPT, and what the start date on the OPT was.

Please help!!!

My F1 visa stamp on my PASSPORT expired Jan 12, 1999.
I applied OPT on OCT 1999 while i was in school and starting date of OPT was 2/14/2000. i finished my school on DEC 1999 but graduated on MAY 2000.

Was i out of status?

Please help!!!
I'm try to get H-1 stamping... is that matter?

Thank you..

Still unclear... Exact dates will be needed, not just months. What is the difference between finshing school and graduating? Arent they the same. Do you mean that you received the diploma in a ceremony in May 2000, but finished all requirements to get the degree in Dec 1999?

Since your OPT application was pending with the INS at the time of graduation (by that I mean finishing school), and since it was eventually approved, and also since there is a 60 day grace period once you graduate (to stay in the US), I think you should be fine. The expiration date of your visa stamp on your passport is irrelevant.

What does the I-94 say????

That is the document that controls your legal status in the US.

My guess is that it says "D/S" in which case, you are not out of status and accumulating overstay until INS becomes aware of your illegal presence.
