I came to the US on a H1-B in June 2002. My company, payed me on a per dieum basis instead of putting me on payroll (as promised on the offer letter). They kept telling me that they will put me on payroll once the company got funded. Aparently I am close to completing 6 months of my stay in the US without being on payroll.Does that make me an illegal immigrant. Is there anyway I can fight back with my employer? My employer believes that me not being on payroll is legal.
Please help out,as I am close to completing 180 days in the US.
