Out of status??

I came to the US on a H1-B in June 2002. My company, payed me on a per dieum basis instead of putting me on payroll (as promised on the offer letter). They kept telling me that they will put me on payroll once the company got funded. Aparently I am close to completing 6 months of my stay in the US without being on payroll.Does that make me an illegal immigrant. Is there anyway I can fight back with my employer? My employer believes that me not being on payroll is legal.
Please help out,as I am close to completing 180 days in the US:(.

The employer is supposed pay you according to the LCA. Do you have paystubs to support the fact that you were paid by the company?
 
I dont get paystubs from my employer. However the employer is paying me a salary in India where I worked previously.I have pay stubs for my indian salary, which I believe does not matter in this case?Am I right?
