Out of status

I think I read somewhere that you can be out of status for 180 days without the USCIS penalizing you. Is this true? and can someone provide more information regarding this.

Thanks,
Mona

Yes, that is 245K. It indicates that you could be out of status for less than 180 days for adjusting to permenant stutus in U.S. without leaving this country. You can search the forum here for more information.

but what about travelling outside us after aplying for i485, once we have a valid AP everything is ok ?????

It depends. If you are subject to the 3/10 year re-entry bars AP will do NOTHING to protect you, and the AP documents clearly state this. If you have been out of status for a period of time and have any suspicions whatsoever that you may be subject to the re-enter bars, you should seek counsel.

yes, this is right. if you are out of status for less than 180 days, it is okay. you can adjust your status in USA. in my case i was out of status for 178 days. i got my GC approval last month. while my case was under process, i used my AP twice. no problem. as long as you are out of status less than 180 days, you are safe.

good luck.

gogi, can you please tell us how your case has been processed? You say that you were out of status for 178 days and got your GC, I believe, under 245k. Did you or your attorney do anything specific to benefit from 245k or it happens automatically? In your documents did you clearly show USCIS that you were out of status for 178 days? I am really interested in real experiences.

thanks.
