Hi,
Can someone tell me whether it is considered 'Out of Status' when someone is not paid but holds a valid H1?
Also, please tell me what exactly 'Legal Status' and 'Out of Status' mean by.
Thanks.

Also, please tell me what exactly 'Legal Status' and 'Out of Status' mean by.
Thanks. ----------- If you stay with a valid I-94 then you are in LEgal/In Status.

Hello Kovai,

I saw your posts in many places on this site today. Dont get tensed yaar ....
I know couple of my friends had bad w2 filing, and they went for stamping, last month. Both of the them got stamped. They were just asked recent pay stubs.
If you are destined to get visa, no one can stop it.

Anyways, if you want to talk more, email me at svam77@yahoo.com

Thanks,
Vivek

Thanks Hathwar and Vivek, for your quick responses.

I have few more clarifications... hope someone could help me.

I worked for employers A(one year) and B(6 months)... and I have been working for employer C for almost a year now.

USCIS processed my second 'H1-transfer for C' based on my 'first H1 for A' and 'first H1-transfer for B'.

I do have paystubs and W2 forms for the period I was with A and C. But, I don't have either paystubs or W2 forms for the period I was with B as I was not paid.

In this case, if I go for visa stamping and if Consular Officer asks about previous paystubs, can I say that I didn't bring them?
What complications would it cause if I say I didn't bring the paystubs/W2 forms?
Will I be denied visa stating that I was 'Out of Status' during the period I was with employer B, as I was without pay?
What kind of immediate access does Consular Officers have for an instant check, related to paystubs and W2 Forms, during the interview?

Thanks in advance!!

That is true Vivek... we don't know what triggers a Consular Officer to fire a question at the interviewee...
If I happen to encounter those questions, that I wish not to be faced with, it should really be my bad time :(

See, if you say that you didnt get W2'S, they may ask some other proof to prove that, you worked... First of all, in most of the cases, they will not go to that extent .....You would have read so many posts in this site. Hardly anyone was asked W2's. If you go to canada, it may not be a problem ....

Do worry Yaar. You would be through.

I am trying my level best not to get worried and take things as it comes...
But still, every now and then, I start hunting for as much information as I could gather in an attempt to find answers for too many What-Ifs that pop up my mind.
I thought it would be safer to have answers for my What-Ifs rather than stutter during the interview. That is why I have been scattering my questions in this forum, lately.
Thanks again for confidence-boosting responses...

Yeah, if you want to talk also , email me at svam77@yahoo.com. I will give my number and we can talk also ...

Bottom Line: Dont get worried Yaaar !!!!!!!!!!Be cool and things would be that cool.

Vivek
