I am going to apply I-140/485 in 2 weeks. I need some assistance from the experts.
My dependents were out of status for atleast 2 times during their stay in the USA. Both times they went outside the US and got their I-94.
The out of status duration for each time is less than 180 days. They now have valid H4 and I-94 for the last 2 years.
My questions are
1. Do I have to submit the 245(k) related forms for this ?
If so how and where I can find the detail of those forms
2. My attorney overlooked into this. Is it a good idea to inform this now to the attorney rather having RFE and reply at that time
3.Is there any fine for adjusting status with the out of status.
Ps: ( Both out of status situations happened during 2000 and 2001 and my labor was filed oct 2001)
