Out of Status - need help

I filed for my OPT on June 16th with the International programs office at my school . Then i got a reply saying that your OPT cannot be processed because I am out of status from May 31st onwards . ( Eventhough my initial I-20 was valid till Dec 2006 since i applied for reduced course load in spring 2006 and said i am expecting to graduate in May 2006 the IPS changed my graduation date to May 31st 2006 in the SEVIS records . I was totally unaware of this change and registered for a summer course and changed my graduation date to August 2006 . I changed it with the graduate studies department but failed to inform IPS ) .
I understand it was my mistake not to inform IPS about the change in graduation date . The only solution was to apply for reinstatement . I followed all the directions given by International advisor at my school . I applied for reinstatement on July 20th . Now i understand that the IPS office got the information that my application is rejected for this reason : The student failed to apply for reinstatement within 30 days of opening the reinstatement on SEVIS .
This is not true . My I-20 for reinstatement was issued on July 19th . I send all the application materials on July 20th . I have delivery confirmation that USCIS San Jose recieved it on July 21st . I also have confirmation that the check has been cashed on July 27th . Then how can they reject the application with this reasoning .
My only other option for getting reinstated is by travelling out of USA and reentering . But before that i would like to know whether i can apply for reopening the case .
I really need some advice about reopening the case or to travel .

Hi,
A letter from your academic advisor along with documentation fro International students office should help you resolve your problem. Hope this is helpful.
 
Out of Status

I am an MS student, but i went to my OPT (without completing MS) which expired on Mar 2007. My school gave me admission back for summer 2007 to complete my MS. However, since I am out of status, they have asked me to go out of the country and reenter. My question is can I go to Mexico or Canada, or have to go the home country for the same.

why are you out of status?

Your OPT ended in March, then you have a 60 day grace period during which you need to get a new I-20. You don't seem to be out of status.

Thanks for the reply, my school says I am out of status, because I did not try to get OPT before March ( ie when OPT expired). I will be getting my new I-20 in april during my grace period. Thats why they have said I am out of status, and I need to re-enter using the new I-20. My question is can I go to Mexico and get this done, will I have issues in getting it stamped again.

as long as you were "searching" for a job, you didn't actually have to have a job.

Well, I guess you can try to get a visa in Mexico/Canada, but be prepared to travel to your own country just as well.
 
Sorry looks like I was unclear in my previous posting. I am not searching for job. I need to go back to F-1 to complete my MS which I left unfinished, my OPT expired in mid March. My school gave me new I-20 but they are saying I need to go out of the country and re-enter using new I-20.

My questions:

1) If I can go to Mexico for getting my new F-1 ( what are the chances)
2) My new I-20 is starting May 29. My opt expired mar 15. Including 60 days grace period, I am assuming I am fine till may -15, but i need to be in status for the 15 interim days. I believe thats why my school is asking me to go out of the country and get it restamped.

What are the chances in Mexico in such situations? or you suggest going back to home country
