I have remained in the US for 8 months without a visa after my I-20 expired. I have been told that since I was on an F1 visa, my I-94 has D/S (duration of stay) written on it and I would receive no penalty for these 8 months when I reenter the US.

Does anybody know any details about this?
 
NO, No, No.

You are out of status for more than 180 days. Duration of stay means duration of your necessary academic studies. Unless you can prove that you
were still in study from your school after I20 end date, otherwise, you are done, because you can not even adjust to greencard if you were outofstatus for more than 180 days.

I read that it is difficult to find for INS if a person is out of status if he has D/S on I-94. If you apply for change of status, they will find it because you will have to submit I-20 copy. If want to go home country, you should leave earliest.

If you leave before 1 year out of status then 3 year bar. If exceed 1 year 10 year bar.
