I will like to seek advice on one immigration matter. A dearest friend of mine is going through a immigration trouble and we are seeking legal help. In brief,

She came over to USA from Moldova in 2007 on J1 visa, change her visa to F1 after 4 months, start going to school for some time but due to financial problems was unable to continue after a month. Its been 1 year and 5 months since then and she is now without any papers. I will appreciate if any one can comment on any possible legal ways to help her. Recently friend of hers has applied for asylum, based on current political crisis in Moldova. Please advice.

Without knowing of your friend's personal situation and Moldova (no offense it is such a small country between Ukraine and Romania), I would say she needs to provide strong evidence that why she would be singled out for persecution. The "political crisis" won't help unless she is personally related.

Also, the 1.5 year out-of-status is a problem. They are very strict on the one-year rule now.

My husband (who's been out of status since 2007 as well) and I just had our interview with the immigration and we got sent to a judge. He's from Zimbabwe and does not have much past persecution, but we had a pretty strong case with "future" persecution, but that was not enough. The guy did not even ask much about that, he concentrated mainly on the past and his family that still lives at home.

Also, your friend's been here for more that 1 year, so her chances are even smaller to win with the asylum office. She may be sent to a judge though, and then it's different.

PS: I'm from Romania. Have your friend write me a message if she wants.
