hey Gurus,
i wanted some information regarding Visitor Visa Extension. MY parents applied for it and it was rejected. my question is whether the 10 year multientry visa that they have is also automatically cancelled because their extension got rejected??? i am not able to get any information regarding that, anybody with similar experience please share ur information here..or maybe direct to a page where i can get this information......

Thanks a lot in advance

NO visa stamped is valid

Rejection has no relation to the validity of the stamp...they just rejected u r reuest to extend so ur parents should leave ASAP to maintain the status... if they fail to leave then there will be issue when they try to come next time

i extended for my parents last year.. but when they try to come this year they had 2nd interview some minor question thats all.. good luck

glrao - when u say that u extended their visa, did they get it or was it rejected?? i think if it is rejected that is when their earlier visa gets cancelled...i didnt find any info on USCIS website regarding this though, the information that i am talking about i got from immihelp.com
dont know what to do. how soon did ur parents leave after their extension was rejected(if it was)....
thanks a lot

yes, your parents' multiple entry visa is automatically cancelled because your parents' request to extend was rejected. Your parents should leave USA as soon as possible (no grace period was available) or they will be out of status. Probably they wouldn't give your parents new visa until much later (probably 1 year or 2 years) because of rejection.

I wonder what reasons you want to extend your parents' extension?

Here's Murthy's information (chat forum) --(http://www.murthy.com/chatlogs/chat0913.html):

Chat User : B-1/B-2 extension is pending. Is it safe to overstay the I-94 date? If INS rejects, is there a week's period before which one has to depart the U.S.? Thanks.

Attorney Murthy : Once a person's I-94 card has expired, and if her/his extension of status is denied by the USCIS, s/he is deemed unlawfully present from that minute. There is no 1-week or even 1-day grace period under law. This means that a person who may have had a 10-year multiple entry visa, that visa stamp in the PP becomes void and s/he is required, under 222(g) of the Immigration and Nationality Act, to apply for all future visas in the home country. There is a small risk that one could be subject to removal or deportation in that week that s/he remains in the U.S., but even if the person is not removed, s/he is likely to find it difficult to obtain another nonimmigrant visa to visit the U.S. again.

thanks USGC485,
thanks for the info. its too bad that they cancel the multientry visa, i didnt have any knowledge of that else would never have applied for an extension. it doesnt say any such thing on the USCIS website , they should provide all information.
