Hi all:
I tried looking for a similar case on this forum. I could not find anything that matched. I am a recent M.S. Graduate student from a university in the U.S. and I am waiting on my OPT card to come in. (should be in soon). the Expiration date on that will be mid oct 2008, My H1B decision if I get sponsored will be made on OCT 1st 2008.
I am a dv 2008 winner with a high case number, AS13XXX, for 2008. I know that I will need to get my green card by sep 30 2008 otherwise I lose it. My question is-- since I have filed DS 230, and will file I 485 and all other forms that are needed for the DV visa as time presents itself; this shows that i am intending to immigrate to the States. Will this jeopardize my H1B application? since H1B is a non intent visa, is there a chance that INS will reject by H1B visa based on the fact that I am showing intention to immigrate through DV visa process? if so, i might have to withdraw my DV visa application and wait on H1B, I have more chances of getting a H1B visa and a green card through that due to the high case number.
what do you guys say?
side note: I had decided to do AOS due to so very little hope from previous years' numbers, which might have to change to CP also since this years case numbers are progressing fairly rapidly
any advise will be god sent.
