I graduated from an ivy league school with a PhD in engineering on may 17th 2010. I left the US without waiting for the commencement on may 1st, because of financial reasons (no salary and just had a baby). I went back to the US only once since around july 16th.
I am/was under the OPT program starting July 17th 2010, which, considering the 10 days of grace period, makes me in violation status since october 27th. Please notice that I have spent more than 3 consequent months away from the US and it could be an inherent violation of OPT status.
Right now I am in my country (italy) and have had interviews but no offer yet, although I am probably about to receive an offer soon (fingers crossed).
Considering that my F1 visa is going to be valid for an other 5 years, I have some questions:
1) am i risking to be denied entry if/when i go to sign the contract?
2) if i find a job in the US what could be the consequences of actually accepting the position and working there? I have been told that controls are not too strict, is that true?
3) would it be possible to consider "unpaid internship" the job I have been doing here for a company in the US, which is not in my field?
4) is there any way I can adjust my status by claiming unforeseen causes?
5) if I receive a job offer, could I apply for EB2?
Any suggestion or relevant comment will be greatly appreciated.
