OPT to H1

Hi,

I've a few questions regarding transfering from OPT to H1. I would really appreciate if someone could answer these questions:

(1) OPT is valid till 30th May this year. If you don't get your H1 within 30th May, can you continue to work based on the fact that you have a receipt notice for H1 B from INS. Also, will you be in status that way?

(2) Do they require your passport to issue your H1?

(3) If you alredy have an H1 and applied for an extension, can you continue to work until the H1 approval?

1) No, once OPT expires, you cannot work unless the H1B approval comes through. But you can remain in the US, if your H1B petition has been filed in a timely manner (well before the OPT expiration).

2) The employer usually asks for a copy of the passport (not original) to file your H1B petition.

3) Yes.
