OPT, i-765, EAD

I’m an international student in F1 status. I apply for i-765 on September 19 using the paper method, but have not received anything yet, nor has the check been cashed in. On November 15 I reapply again for working authorization using the electronic method. Including with the supporting document I attached a cover letter explaining my situation (apply almost 2 months ago and no conformation receipt or check hasn’t been cleared). I’m graduating on December 19th and if I do not get the workings authorizing what is my status? I’m currently working (using my CPT) and they offer me a full time positing starting on January 2, but with no paper I know I cannot work. Is it legal for me to work voluntarily (for free) so I do not loose the offer? Do I have to change my status (B2 for example) so I stay in status? What are my next options anyway? Can the company apply for a H1B directly?

The International advisor at the University should be able to check the status as they can call USCIS directly. Normally, OPTs take about three months to get processed so you'll probably get it just in time for 12/19. Have your Intl. advisor call USCIS asap though! After graduation, you have 2 months when you're legally present. However, you can not work without the OPT. If you work on a volunteer basis and the company does not have you on the payroll, you should be OK. I don't think you would need to do that but USCIS sometimes loses applications so I hope this is not the case with you. "Kusmet" if you are from BG. Hi,
I am having a similaar problem.
I applied for OPT in august and still nothing, it has been over a 100 day's.
My international advisor at the university is clueless and I am getting worried.
I Have called the USCIS and now they say I have to go for a biometrics appointment.
I have never hear that any one applaying for OPT had to go for an biometrics appointment.
Does any one now what to do?
 
I don't think biometrics are required for OPT applications. Your international advisor would have told you if they were needed. It is your international advisor's responsibility to call USCIS and check the status of your application as s/he submitted the application on your behalf and s/he had to make sure that everything is correct. I remember when I applied for OPT myself several years ago, my international advisor called USCIS couple of times to check the status of my application.
Regarding your call to USCIS, the customer service agent might have given you the wrong information. To speak to someone who is more knowledgeable you have to ask the customer service to escalate your call and transfer you to USCIS officer, which they should do as you have waited more than 90 days for the OPT. Hope this helps.
