OPT expiring-Applying 4 both H1B - F1 ??

Hello everyone!
My Undergrate OPT is expiring in May 31st, 06. My H1B petition package is ready for Apr 1, 06 submission. The problem is that I am going to have a 4 month gap until Oct. Therefore I am also applying for graduate school. The question are:
- Is it valid to apply for both visa status H1 and F1 at the same time?
- Any difficulty?
- Is anyone in the same situation? Please share your experience.
- While on H1B, can the person go to school as part-time student?
- Currently, under OPT, I am working for the company that would file H1B for me. Does this somewhat violate some rules saying that the employer cannot employ workers before their H1B has been approved?

Hey Man,

I got a similar situation and my opt is expiring in april. My employer says he will do my paperwork but the h1 wont come before oct. so i dont know if i can work bt that time or what.... its a tough call. do u have some infoo?

About me. My OPT expires on Aug 29,2006( taking into account the 60-day grace period). I have applied for my H1-B ( recently through a consultant under the masters quota, still waiting for my receipt #).

In the mean time I'm planning on taking a kaplan ( GMAT classroom course) to stay in status. I was told by kaplan they can issue I-20 ( for 6-months)with-in a weeks time added I can give them all the paper-work they need.

So as of now I'm planning on getting a kaplan I-20 starting July or Aug,2006. And just wait for my H1-B to be approved.


I DON"T KNOW " if my H1-B will be rejected as I would be going on my F-1 after I filed for my H1-B."

I DON"T KNOW "if I'm going to a get a CONDITIONAL H1-B( in which case I'll have to go to India for Visa stamping) or a H1-B with I-94card ( in which case I can go to Canada/mexico in my free time for my Visa stamping)."


This is quite confusing for me and every lawyer and consultant has his/her own version.
