OPT Expired, got a new I 20..can my compnay apply for H1 B? PLEASE ADVICE

Hi,

My OPT expired on 15th may 2005, i just got a new I 20 form a small gradutae school for a MBA. The compnay where I interned for an year has offered me a full time position and is willing to wait till october.

How can i make sure that i am in a legal status now. I mean the school did issue me a new I 20 with 3 years validity. But my opt has expired.

Can my company file for my H1 B now?
Can i drop school once i get my H1 B?
Do i need to get a new visa from another country before i can apply for an H1 B visa?

Yes, you are in F-1 status and will remain in F-1 status if you start school in the first available semester.

no, you will need to apply for a change of status from F-1 to H1B, without leaving the US. The company's lawyer will help you with the paperwork.
