OPT Expiration Issue.

Hi All,
Got a question. Any kind of response would be appreciated. I did try searching for information on the forums but didnt find what I was looking for.
I am on a F-1 visa and my OPT expires Jun 12,2006. I have a 2 month grace period after my OPT expires and hence I can stay here legally till Aug 12,2006.
My employer is ready to file for my H1-B visa asap, but I would have to wait till Oct,2006 before I can start working. My questions follow:

If my employer applies for my H1-B before my OPT expires, can I stay here legally from Jun 12,2006 till Oct,2006, without working.

Thanks a lot for replying. So what would be my status from Aug 12, 2006 to Oct 1, 2006(the date my H1-B visa becomes valid).
