I know the rules say that your OPT is valid for a max of 14 months from the date of graduation.

But what if the INS itself delays the issual of the EAD beyond 2 months of your graduation. Does the EAD then remain valid for 12 months from the date of issue, or only for the remaining period till 14 months from date of graduation.

My Example:

Graduation date is Dec 14,2002.
EAD issue date beyond Feb14, 2003 (most likely)

BTW, My OPT EAD Appln receipt date is Oct 4, 2002 (It's been over 4 months). I have a OPT offer that I cannot take and don't think they're going to wait forever.

anything one can do to expedite the process. What are the
implications of the delay? Would it be considered out of status if
one has graduated and not received EAD for more than 2 months?

The 12 month validity will not start on the day they issue the EAD, but on the start date mentioned in your application. However, if you have not received the EAD within 90 days (or is it 120 days - see the receipt notice) from the date of the receipt (not the day you applied), then you can apply for an interim EAD. This interim EAD would be valid up to a certain time (is it 240 days?).

There is no general way to expedite the process for F1-OPT based EAD.

Can you put it on the board when you receive your EAD? Also which service center did you make the application to??

This is so frustrating...I have no idea why its taking so much time when I'm sure all the records are so easily accessible from the schools..
 
Sure, will do. I sent it to the Vermont office.

I am also considering going to the Boston district office and meeting an immigration officer there to find out more. If someone has done it before, I would appreciate their suggestions and tips.

I did it at the Texas service center's Dallas office. It's actually a big pain.

I reached at 6.30 am to be let in when the office opened at 8.30 and waited till about 12.30 pm to be able to talk to an officer, who curtly told me that they do not issue interim EADs. She also said that my case was taken up by an officer only on Jan 7th.

What got my hopes high at that time (10 Jan) was the fact that I met another person from my school there whose appln had been okayed when he ran the online status check but had still not received the paper notice. And he had a receipt date of (around) 15 sept. So I assumed I'd get my approval by Jan end at the latest.

But then here I am still waiting...
 
processing times

I was wondering if the "processing times," for example, on

http://www.immigration.com/processing-times/vt.html

mean that all applications with receipt dates before the given date have been processed? The date for I-765 (other) is 11/7/02 and my application receipt date is 10/2/02. However, the status on line from ins.gov says that my application is still being processed. Is it possible that my application has been processed but the decision has not been updated? I would appreciate any information.

Similar case with me too!

My Graduation date is Dec 22, 2002. OPT application receipt date is Sept 23, 2002. And, I haven't received my OPT yet as on Mar 06, 2003.

But I wanna share this with you guys that, I applied to California service center (The sluggish one). One thing worth noticing is, in my opinion, service centers do not handle interim EAD. One should go to INS/BCIS field office in order to get interim OPT.


For example, in my case, Dec. 22, 2002 was when 90 days were completing. On Dec 23rd I went to INS field office (not service center) in downtown LA and got my interim EAD, which is valid for 8 months. I know atleast 5-7 guys who got their interim EAD this way!

If I would have gone to CSC, I won't be surprized if they tell me that they dont issue interim EAD. So, please cheak with field office. I also suggest to consult Intl Student advisor at your school and ask them how can you get interim EAD.

obtained interim EAD!

Hi,

I got an interim EAD from the Boston district office. It is valid for 8 months. The wait at the INS office was about 5 hours, but there was no problem otherwise.
