OPT-->B1/B2-->H1B

Hi
I came to the US on a B1/B2 visa with 10yr multiple entry. I then changed to an F1 status.
I am currently on OPT that is expiring on the Jan 05/2006
My current employer was a little late and therefore I could not make the cap for the 2006 year.

My lawyer advised me that I can change my status to a B1/B2 temporarily for 6 months and within that 6 months I can apply for a H1B.

How does this affect my ability to work ?

If I apply on April 2006 and do premium processing will the H1 get approved before my B1/b2 runs out?

Do I have another options?

Any help will be greatly appreciated
 
If you apply H1B in April 06 with premium processing, your H1 may be approved very soon, however, you can not start working until start date on H1 petition comes. Earliest date you can start working is Oct 1 06.
