Me and my wife had filled for CP and I485 as well. We have an appointment this 6/04 for the CP. With the current situation in TSC, would you still advice to take the CP route or just wait for I485 approval? My lawyer is really insisting on the CP route for some reason. Thanks in advance.

Take the CP route if your record is clean. This approval speed will continue only until Oct 1 when the H-1 B gets started again and resources will get reallocated or there is always a possibility right now that the 485 resources could get re-allocated to process I-140 backlogs. So take the more definite CP route.

My two cents.
 
I am joining Ravidhya in his surprise. I also thought, you can't do both CP as well as 485 both sametime. May be it is possible.

Ned, throw some light man. it might be useful for some guys on this forum.

There is a question on the I-140, where you need to select how do you want to proceed: CP or I-485.

If you decide to do I-485, your file stays in USCIS. Changing your choice to CP after that is difficult and you will need to file I-824 - Application for Action on an Approved Application or Petition. Just looking into I-824 and moving the file to the State Department will take a few months and this is going to nullify the I-485.

However if you have decided upfront to go for CP, you should be able to file I-485 later and both will go in parallel.

All my friends who did CP have long forgotten the pain and are going soon to be eligible to apply for citizenship. If you can get out of TSC, do it.

I really haven't heard of anyone who got rejected at CP so far. Plus the thing with TSC is that it is so unpredictable and it might go into a "Sleep" mode and then you will be very frustrated. Lot of people would love to have an option like you have now. I know I would although TSC finally approved my GC after 20 months in 485 stage.

My lawyer processed my CP and I485 at the same time. I don't think CP nullifies I485. My record is clean as far as me and my lawyer is concerened.
But the aggravation of travelling and the amount of anxiety involved is too much to bear. If you what I mean.

I am positive you can't do both at the same time. At some stage you will have to decide the route.

CP is safe and travelling to home country is no big deal - just visit there and have fun. I don't know a single case of CP that was NOT approved.

Remember it is PROCEDURAL issue - not a decision that Counsellor has to make. It is PROCEDURE - paper work only.

But I am positive both routes are not feasible at one given time.

At the time that my I140 (NIW)....

was approved my lawyer indicated to INS that we would like to have CP and I485.
I filled both of them after I140 was approved.
