I am an RN (OPT expires in Jan)My employer is filing my I140, but evidently I'll go out of status in Jan as priority dates are pretty retrogressed. If I find employment with an H1C issuing hospital, can I qualify for H1C visa while my GC application stays active with old employer? Hope I am posting at the right place

Dear All,
Here is my situation.
I went to US in 2004 on H1B visa sponsored by Company A. I got it transferred to Company B in August 2006 and came back to India. I got it stamped. But after that I could not travel.
Now I am in company C in India. If this company applies for my H1, will I be exempted from the H1B Cap?
Can someone plz let me know what is the way out for me to get a H1 from this company?
