Online Status Changed. Any Idea?

Hi LILUS,
Yes, we can re-apply I-140 with proper documents which will overcome the reasons for denial. But in my case, this officer gave reasons about the H1B Violations in the company.
So till we appeal and prove that there is no violations, I cannot reapply. Even if I apply, same decision is going to be given again.

Please Don't ask me then how come other people are getting approval? Those people are lucky and their file did not go to a VERY "WELL" TRAINED/RACIST Officer. If you see my denial notice, you will laugh. This officer might have spent a lot of time to guess and find out all these stupid reasons and in that time he/she could have processed some more cases to reduce the backlog a little bit. (No wonder why BCIS had/has/will have backlogs FOR EVER)

I am confident that my case will get approved, if it goes to a Good Officer who knows how to process I-140 petition. If a fool says 8+3 = 15, then there will be somebody who knows that 8+3 = 11 and they will surely correct the fool.(Whether the fool listens are not that is different story and It is very hard to deal with people who says that they will not use their Sixth sense)

Hi ,

My I-140 was denied because my labor certification required US BS degree and my education evaluation says (3 yrs degree + experience = US BS Degree.)

I have refiled my I-140 in OCT 2002 and did not hear from INS/BCIS till now....

Hi Nanshi & others,

My 140 got approved yesterday. Checked online status today and got to know. Now the question would be should we believe the online status... I guess "Yes" cos' all my corresponding (485, 765, 131) for both my spouse and I got reopened. The status says they are reopened.

Let me know if you guys need any details.

Congrats for your approval. It is real quick. So CSC did not send to AAO for further review. Can you please give us some details like

1. When all the cases(I-765, I-131, I-485) are reopened? Is it before approval or After approval?
2. What automated voice messaging system says now regarding your I-140?

1. Did you check the Online status immediately after the denial around April 1 or 2?
2. How did you come to know that you case was denied?
3. You posted that the online status was saying that they received your response on Feb 14, 2003...... From which date the online message was saying that? Before denial or some times after you file your appeal? Kindly clarify.
4. Did you get any message like "On April 1, 2003 a written decision was sent ....."?

Here are the details of my case

My 140 was denied on the grounds of company financials "ability to pay".

My 140 was applied on Nov 27th 2002 (EB3, Orginal Labor, CSC)
RFE on "ability to pay" on Jan 27th 2003
RFE Replied on Feb 21st with company's 2001 tax docs
Denied on 1st April
Appeal sent (I 290 B) on April 30th. Sent additional docs like W2s, 6 months paystubs, bank staments & other related docs to prove that the company can pay.
Approved on May 7th.

Nanshi, below are the answers to your questions:

1. When all the cases(I-765, I-131, I-485) are reopened? Is it before approval or After approval?

There is no before or after... on May 8th when I checked the status of all my apps (140, 485, 765, 131). 140 changed to approved, 485 changed to reopend and same with 765 & 131. All happened at once. I read it on murthy.com that all other applications get reopened automatically.

2. What automated voice messaging system says now regarding your I-140?

"This case has been approved. On May 7th and approval notice has been sent"

3. Did you check the Online status immediately after the denial around April 1 or 2?

"Yes , I did. It never said it was denied, the status always remained as "your rfe was received on Feb 21st" "


4. How did you come to know that you case was denied?

"On APril 4th I got a written notice from BCIS (form both myself and my spouse) that my 485 was denied beacuse my underlying 140 was denied and then my lawyer faxed me a copy of 140 denial notice".

"I never got such a status online. "
 
Yesterday, Automated Voice Message status for my I-140, I-485, I-765 petitions were updated from Denied to Pending, like what online status says since April 28, 2003.
