Online Status Changed. Any Idea?

Hi All,
My I-140 got denied on Dec 06, 2002 and we filed for Appeal. Texas Service center received on Jan 02, 2003. Today I found that all of my denied cases (I-485 , I-140, I-765) online status has been changed to Under Processing. Anybody got this type of message before, after denial. What does it mean?

1. Appeal has been accepted and I-140 is going to get approved.
2. Appeal has been reviewed and any decision on I-140 can happen(Approval or Denial)
3. It means nothing. As usual, just error from BCIS.

Till last Friday(04/25/03) , the online status was as this case was denied on December.......

But yesterday(04/28/03) at around 7:00 PM EST, I found it was changed to "We received the requested documents on June 14, 2002.........." (The message, which was there before denial).

It sounds like they have referred the case back to INS for further
adjudication. If I am correct, it means that INS did something wrong and needs to redo it. It's certainly a good sign since it appears that INS has reopened the case. Someone should now call BCIS and speak to an IIO to find out more information if possible.

Thanks for the message and Email. I just called BCIS (both Texas Service Center and National Customer Service Center) for the status update. Their system still shows all my cases are as Denied cases. Only the online status has been updated.

Do you have any idea, how long I have to wait to get any information?

Receipt for Appeal ?

When you appeal after I-140 denial, do you get a receipt for that appeal or not ? I have also have filed appeal after I140 denial but have not received any receipt.

When I type my I140 receipt no. The online status says that " on Date .............this case was transferred to our Administrative Appeals Office for review. That office will notify you of any further action taken on this case"

Yes, We do get a receipt with your appeal. Your attorney might have received it.

1.When this online status changed? Or What date they sent it to Washington?
2.What was the online message displaying before this message?
(Denied or Pending).

Did you check the Automated Voice mail? what is the message it say? Did you/your attorney receive any notice by mail from them stating it has been forwarded to AAU,Washington?

No, I have not checked automated voice mail. I am not sure if my attorney receive any notice. I will find out though.

The online status changed in february some time.THe message before used to say that the decison has been mailed to us,( Which was denial)

Thanks for the information. I was thinking that when they are reviewing the appeal, the online status will change as this case is under processing. But in your case online status went from Denial to sent to AAU.

Can you please check the Automated Voice Messaging System tonight and let me know what
message is coming? When I checked AVM, it still says the case is denied in December 2002. I just want to confirm after some action on the Appeal, there will not be a change in the Automated Voice Messaging system. If my guessing is correct, you should hear message as "Written notice was sent on ......" in your case.

I have to take major decision soon and Your help is very much appreciated.

So when you check your status online do you put your I140 receipt no. or do you put the receipt no you have got after an appeal ? Sorry If I am asking a stupid question.

There is nothing called stupid Questions here. We are here to help others who need help. O.K. Back to your question,

If I enter my I-140 Receipt number then it says "we received your response on June 14, 2002 and it takes ........."


If I enter my Appeal Receipt number, it says " Your I290B petition was received on January 02, 2003 and it takes 120 -180 days to process ......."

Hi nanshi,

I checked the automated message and it says the same as the website. I also talked to the immigration officer and she said that they have sent a receipt but she can not give it to me as I am the benificiary. Anyway, just to let you know.

Hi Nanshi,

so does that mean your case is considered as "motion to reconsider". My 140 is denied on financial grounds of the company. My lawyer applied for Appeal.

How are you checking you status online, is it through your denied 140 number or the Appeal receipt #.

I will greatly appreciate if you could furnish some info on this.

That's what I wanted to know Whether the case is opened or not. Online status says "Processing". Automated Voice messaging system says "Written notice was sent on December....." From their own experience, some of the friends in this message board say Online message can be wrong and unreliable.

If I enter my I-140 Receipt #, the online status NOW says "On June 14, 2002 we received your response to our request...."
And if I enter my I-290B(Appeal) receipt #, then the online status says "Your I-290B Notice of the Appeal to the commissioner was received on Jan 02, 2003......"

Can you please give us some more information regarding your case?

1.Which Service Center?
2.Date of Appeal?
3.Current Online Status of your I-140 and Appeal(I-290B)
4.Current Automated Voice Messaging System message for I-140 and I-290B?

1. My service center is CSC
2. Date of Appeal is 29th April 2003
3. Current online status on Appeal says "Your response for our request for further evidence was received on Feb 21st and it takes 60 - 158 days to process this kind of case". This status hasn't changed since I got my RFE and replied to it. They denied my 140 on April 1st.
4. I don't have the 290B receipt# yet.
5. AVM says same as online.

My140 denied,
So from your posting, it is very clear that Online status messages are not reliable. Better I will think of some thing else like Labor Substitution, instead of waiting for this approval. I don't have any other confirmation that my cases are opened, other than online status change.

Sorry to know your plight that your I-140 is denied eventhough other folks in your company are getting approved! It's horrible how the ******* INS works here where they approve for some and do not approve for others within a same company.

Did you ever thought of reapplying I-140 along with supporting documents regarding financial info? My lawyer is saying that we can re-apply along with supporting documents and INS may approve it. I read in murthy website also that one can reapply I-140 even if it is denied.
