One More Important Issue

Nadi you are right....but i think there is no reason to panic regarding this issue....since not many companies are doing this....(i think only 10% of labor may get misused....because not many companies will be taking cash for labor from employees....very small companies will be doing it...)

well this is just my assumption....can someone please debate this..
 
180 days is wrong

In 180 days i can assure u, atleast 50% of the LC subs will DEFINITELY be misused once. 6 months is MORE than enough time to misuse this.

The 45-60 day rule cuts the problem AT SOURCE. If you cant find a "buyer" on 45-60 days, the evil intent of selling is defeated right there.

Abt the PD. I agree that is what is driving the price. HENCE to Negate that the PD shud be changed. If LC subs is to be allowed, SIGNIFICANT changes need to be made to avoid screwing over ppl who are standing in line legitimately.

Agree. But it will be used only once! No reuse after that. It's kind of compromiss - can use LC if guy left but LC can be used only once for one person. Then company can revoke I-140 but will not be able to use LC again and again.

Correct me if I am wrong
Last time when UScis passed labor substitution elimination and 45 day limit,
the rule was that labor substitution is totally prohibitted and the person on whose behalf the labor was approved should apply for I140 within 45 days.So what I am trying to say is that the labor substitution alone even without 45 day or 6 months or 180 days limit would solve the problem.No company will be able to sell the labor and again their is no point in saying "PD should be the day he files I140".If such a law comes only the person on whose behalf it was filed can file I140.If you are referring to people who already filed with substituted labor ,we cannot change their PD ,they are through.
