one more FBI background check victim

about 2 weeks before i had my greencard interview @ phoenix office , everthing was normal , office said everthing looks ok after 15 mins asking us few standard immigration questions, then he said my background check still not approved by FBI :mad: , so they will send my greencard in mail once it's approved. i know lots of people in this forum going through this painful process after interview , can you pls share any recent sucessful experiences with CRAZY background check clearence, my EAD will be expiring by end of JAN 2006, so i just applied online for renewal.

anyone had any luck with this crazy process recently??i even tried calling FBI#, they said no longer take calls for this request. :mad:

hopefully someone will help get out of this crazy last hurdle :)
 
My interview was back on August 23/05 and was approved pending the FBI name check. I received my Green Card in the mail on Oct.28/05 ... 67 days later.
I did renewed my EAD just in case because my old one expires on Oct 22/05. The interviewer said I can work of the new EAD until I get the GC ( the GC was good from the last day of my old EAD, so I wasted the $175 .. but hey .. what the hell, its over now .... Hang in there and good luck
 
thx tams :), i just apply for my ead renew using online yesterday, do i need to send any supporting documentation for NBC??


i can't think any documentation i need to send it to NBC, last time i gave fingerprints in feb 05, so i don't i need get my finger prints done, any ideas??
 
The only thing I sent with the application was a photocopy of my current EAD card and the fee. best of luck.

When you get your NOA, it may ask for the fingerprints. If so, I suggest going ahead and set up an appointment just in case to avoid any delays.

Thx Tams, i already schedule info appointmnet @ local office for fingerprinting.
also after your interview you did any to speedup the name check process or just waited 67 days ??i talked NBC customer service they asked me to wait for 2 months, if not done before then they will inquiry FBI for status
 
I just waited after the interview since the interviewer who approved the AOS had said my part was done. He said he has also approved my EAD renewal so, I can continue to work off that until I get the Green Card. So, I wasn't concern about the time I had to wait. I actually thought I had to wait longer.

I ve just came back from USCIS office. I made and Infopass appointment to ask why my case is taking longer to be approved than the average of the cases that are being processesing in my Local Office.

They told me that they cannot complete my case in the normal time due my Name check is still pending ( my fingerprints were cleared the same day that i submitted them).

Now its been 3 months since i did my biometrics/fingerprints.


Questions:
1)IS NORMAL THAT THE NAME CHECK IS STILL PENDING 3 MONTHS LATER?
2) WHATS THE AVERAGE TIME TO HAVE YOUR NAME CHECK CLEANED?

I am from south america and have an uncommon german surname.....

Ill appreciate any kind of answers.

I wouldnt say its normal, but that has been the trend for a lot of people here. While some get cleared in less than 45 days, some have been waiting for years.

2) WHATS THE AVERAGE TIME TO HAVE YOUR NAME CHECK CLEANED?
FBI is "SUPPOSED" to clear the namecheck in 45 days or less, but that doesnt seem to be happening consistently. To answer your question, no idea. No one knows

Woa I'm from Brazil and my last name is Strefling (german). I just had my fingerprint done today, hopefully I wont be stuck in this.

I had the similar experience at the interview , and I have been waiting for more than 4 months for FBI clearance since I was interviewed.

:mad: I got my inteview in 06/2004 approved, Name check pending, still waiting, I tryed, congresman, infopass, email to FBI, nothing works, just wait, wait.
 
Most people told me that in FBI's reply email, they would tell you the name check started at when and done at when. The only problem for FBI is very slow to reply an email (half year or longer). According to 7 people that I ask, FBI always get it done in 30 days. But after FBI submits it, USCIS will put the files on shelf or forget where they are. So definately call USCIS each 2 monthes to bug them, pretending you don't know anything about the name check, pretending you are suprised by how slow FBI is, they may double check it for you, if getting a rude customer rep. then call again trying to get a nicer one, you know lots of cases USCIS even forget to submit it to FBI. Also you may notice that lots of people claimed that they just paid EAD renew fee and did finger print then got GC before EAD, that's not a coincident! (I'm in statistics major) Yes, there're very limited people renewed EAD a few times still haven't got GC, that may be due to USCIS hasn't submitted or because FBI hasn't cleared their cases yet.
My summary is, 6 monthes to less a year FBI check is normal, one year or more, there definately be something wrong. But for longer time, you have more chance to get 10 year GC and don't need to deal with USCIS longer. Good luck and wish God bless all of us!

Please help me understand this.

I had my AOS Interview on Feb 05, and was told that my approval was pending the results from the FBI name check. It's 23rd month of our marriage and I am still waiting. So if I were to get the approval letter next month, then I should get a 10yr Green Card.

According to FBI's testimony to congress, they take maximum of 120 days to process the name check request. Now that's just a number they gave to the congress. It sometimes takes longer and sometimes less than 30 days. It all depends on unknown criteria. I agree that USCIS makes mistakes in submitting and processing a few files but that is not the case everytime. However, you are mistaken if you think that calling them every two months and pretending that you don't know anything about FBI, you are grossly wrong my friend. Everytime you call USCIS regarding a case, they record it. Everytime you talk to a CS rep., they log it. If they tell you not to call within the next 6 months, they really mean it. Ofcourse you can call and they will even reply to you as a nice gesture but if you show ignorance, they will refer you to the call you made 2 months ago.

Hey tams...

If I may ask, if you only had to wait 45 days for your interview ( I read that from another thread)... how come your EAD was already expiring? Isn't it valid for a year? And it would take you a minimum of 1-2 months to actually get it.... :confused:
