H1 b visas availle for this year would be only 36000 and 65000.

one the news ticket window.

The cutting of the Visa makes sense to me, I would be surprised if the congress keeps the 190K quota.

when thousand people are applying one job, there is no reason to bring more H1B workers here.
 
visa transfer?

If I change my employer and apply H1B with the new employer, is that a visa transfer or a new visa application? Would that be affected by this new H1B cap? I have an H1B now.

When you change your employer while maintaining your status, it's a H1B transfer. And H1B transfer does not count towards the cap.

are you sure about that? Can you provide a link to the law or regulation.
I thought every H1B application is the same and counts towards the cap (this is why the number of H1Bs in the country is highly overestimated), the only thing for renewal or changing employers is that you can start working almost immediately, that is, having just the receipt.

Though, H1B for educational and some government institutions are exempt of the limitation.

Look at the AC21 statute. Renewals have NEVER been subject to the cap, only "new employment" petitions. You are also cap-exempt under AC21 if you are working for a non-profit or an educational institution.

A. No, H1 transfer is a separate process, and it has nothing to do with H1 cap. It is a transfer of your existing H1 approval to some other company and not a new H1B.

The process for an H1B "transfer" is the same as filing a new H1B petition and, therefore, it generally could take a similar amount of time to process the H1B.

The only major difference is that the person who is already on an H1B status does not fall within the H1B cap, so will not need to wait until October 1st to start working if the H1B quota has been used up in that fiscal year....
