I am applying for AP by my self using the new form. There is a field of "Class of Admission" that I do not know what kind of information I shall fill in.
When I contacted my attorney about this (way back when I filed for AP), she told me to fill the last mode of entry to US(H1 visa at that time). I have also seen people use AOS and not having any problem (infact I have read some where else that it should be the current status).
Either way I do not forsee any problem (at worst an RFE).
"Mode of Last Entry," is the absolute right interpretation. Your attorney is absolutely right. Even though your H1 may have expired now, if that is how you got your last entry, "H1-B" will be the right choice. If you entered using AP last time, then you should put "AoS" or "Adjustment of Status."
Current status as to AoS or H1-B does not matter. IT is the status during entry that matters.
