Yesterday I received in mail AP approval for me and AP's RFE for my wife about marriage certificate. I applied without lawyer and 101% sure I sent our marriage certificate in her case. Anyway I will replay for RFE tomorrow.

AP wac-03-123

By the way online message is still the same for both cases

Your I131 APPLICATION FOR BCIS TRAVEL DOCUMENT was received on March 6, 2003. We mailed you a receipt with information about processing. It is taking between 30 and 60 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

I received my AP one month ago. But the online message still is: Your I131 APPLICATION FOR BCIS TRAVEL DOCUMENT was received on Feb 6, 2003. We mailed you a receipt with information about processing..... It is different with AVM. AVM change instantly.

Did you include translation and certificate of translation along with marriage certificate?

Yes, I even went to notary public to certify that it was a true copy, although it's not required by BCIS.

Do you think I should file complain?

Then I think you'd better call IIO first. If they can confirm that the document is actually there and have the RFE status dismissed then you might have no need to reply.

Tasse,

My suggestion, don't mess with the system. If they issued RFE, just reply. Don't try to fight it cause that might (will) screw up your case further. Some IIO cancels RFE, another expects a reply, that is the end of the processing on your case. It will probably be deemed too complicated and pushed up to the supervisor and you know what that means!

Go ahead and reply to the RFE! This time get a certificate of mailing and return receipt on it!

Good luck!

On May 5, I sent replay for RFE, today case status was updated

On May 14, 2003, we received your response to our request for evidence or information. It is taking between 30 and 60 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case.

It happened the same in our case.
Mine approved & RFE for Spouse, since we didn't put Marriage Cert. with our initial application.
Our lawyers replied with the Marriage Certificate.
Spouse got his AP approved after 2 weeks.

Tasse,

Sounds about right. I wouldn't put the time taken as more than 2 weeks from now for your spouse's AP!

Funny that they can't pull the marriage certificate up from the 485 case and refer to it for approval. I mean the only reason your spouse can be filing for AP is because she has already filed for 485 right? Then why additional proof that she is married to you?

This morning I checked status of my wife AP renewal case wac-03-123. It is approved on May 15, 2003 after RFE. They are speedy now.

Forget pulling from 485. They can't pull from your earlier AP. Ours was AP renewal. My husband was adamant that we don't have to give all those documents, since it was a renewal & that INS would already have all that in file. But anyway, after RFE my husband doesnt spell logic & INS in the same sentence.

I'd be happy if they pulled their heads out of their asses and did some work for a change.

On May 22, I received Advance Parole approved on May 15 after RFE.

Now I have only one problem to tell my manager that I want to take a vacation.
