I came on J Visa, Married a Green Card Holder
Hi everybody,
I came to US on a J1 Visa, the stamp of the J1 Visa on my passport says "Bearer is subject to 2 year rule. 2 Year rule does not apply in xxx(my country). Also, nothing was written about "subject to 2 year HRR" on my DS2019 except the official stamp and signature. No checkbox was even ticked. Now that I am married and my spouse has a green card. I want a change of status to GC. My DS 2019 is still valid for more than 1 year. My questions are as follows:
1. Does the 2 year residency apply to me since it is written on my passport that two-year rule does not hold in my country?
2. Is it risky to apply for advisory opinion?
3. What are the steps I should take towards my goal - getting a green card?

Please help me.

Thanks.

1. Yes, it probably applies.
2. No risk, just get the advisory opinion.
3. There is a 10 year wait to get a GC through your spouse if your spouse is not a US citizen. You have to wait outside the US during this time. You can apply once your spouse becomes a US citizen though and in that case the wait is much shorter (6 month or so).
