I am in this country since last 11 months on H1B and this is valid till end 2006 as per I-94 stamping. I joined my friend's startup company but due to cash flow problems unable to produce paystubs and I am given bare minimum living allowance only. From this month, they want to regularize by paying taxes and print paystubs and asked me to re-enter to US (go to Canada for a day, leaving my family here itself who are on H4) and come back with a fresh I-94. Are there any loop holes in this process? Will this affect my Green Card process in future as I am with no paystubs for almost one year?
Also, can I ask for backpay slips for at least last three months so that I can also ask for W-2. I was told I cannot ask for 1099 as it is illegal for an H1b employee.
