On 7th Year Now. H1/EAD Matters?

Hello,

I am on my 7th year H1 now. My 485 is pending and I received my EAD recently. Do I have any advanatage in remaining in H1 and not using EAD ?

You still have couple of advantages in H1B.

Yes. You still have some advantages on holding to your H1B.

1. From what I heard: INS in rare cases denies an I-485 application. In such cases you will need a backup plan to apply for an MTR. Otherwise you will be out of status.

2. If you start to use your EAD then every year you have to start renewing it, which not only costs money and time (for paperwork) but INS will not approve the EAD on time (before your current EAD expiration). In such cases your job could be in jeopardy. I experienced personally.
