on 485, travelling to China

Dear Sir/Madam,

I have been on H1 for 7 years now and have an approved H1 for 2 more years. I haven’t had the H1 stamp on my passport for the last 2 H1-Bs issued (as I never left the country). I (along with my Wife) am waiting for adjustment on my 485 (EB2); I have an approved 140. I have finished my biometrics as well. My priority date is Sep 16 2005 and my 485 receipt date is Aug 24 2007 from Texas. I have had a advance parole issued to me before which expired a few months back. I know I will need a AP again if I have to re-enter the US.

The problem I face is this. I am in a MBA program, and one of the requirements is to travel to China in Aug 2009 for a project. I guess I would need a tourist Visa (or is it a student Visa?). I have heard that people (from India with similar status as I) face tremendous difficulties getting one. Can anyone kindly provide any input on the situation?

If the above is somehow possible, I would like to take my Wife and Kid along with me as well. The kid I guess should not be a problem as she is a US citizen. But my Wife is in the same boat as I, except she was on H4 and traveled to India and entered back on Advance parole.

I am consulting with the MBA program as well about this, but would greatly appreciate all inputs an advice.

the best for you is using advance parole, although you can try H1B, which delayed me for 2 months deu to background check during visa application

your wife has to use advance parole for that she has done so and the H4 is invalid since then
