I am applying for AP within a couple of days. i.e. before end of October.

My H1 is expiring on 31st October and I intend to use my EAD as 140 is approved > 180 days etc.

What should I enter under number 3. "Class of Admission "
for both spouse and self.

Were you on H1 status since your last entry to the US ?
If so, write "H1B" in class of admission.

Some folks also opine that it should be "H1B/AOS Pending"

Either should work.

yeppo be careful, using EAD is abosulutely nothing to do with 180 days of 140 approval. I guess u r confused with AC-21 situation. I understand that ur H1 is expiring, if u have filed for AOS then u can apply for 7th year H1 extension
based on pending AOS. Being on H1 is always safer then using EAD.

I do intend to use Ac21 as I intend to maybe switch if I get a better offer. Being on an H1 is safer agreed, but the job options get limited unfortunately. Agreed that the Green card is very important but thankfully it is not everything for me.

Sometimes we get an offer which we like for some reason (money or knowledge) and this maybe the only way then.

Incidentally yes it has been more than a year since my 485 was filed.

well, ur options are not limited. There are many people who do a H1 transfer
and pay you around 80-90% of billing rate. I'm sure that $ amt almost equals
what GC holders get.

Ofcourse u r safe to use AC-21 and work on EAD, but if u take that option
posted above you can maintain H1 status and make almost similar money
as GC folks, plus ur GC will also continue.
 
That is true. Sadly the place where I want to join is not doing H1's. Also as someone has mentioned in this forum that I would have to then come back and work for the original GC sponsor for some months when GC is approved if I change jobs using H1 transfer before GC gets approved. That is something also I want to avoid.

--- where did you read that??? if you are with A and A filed LC for you A filed I-140 for you, and you filed I-485 and your I-140 is approved AND I-485 is pending more than 180 days you can join B with H1 transfer and once join on H1 transfer send the letter of new company FUTURE PERMANENT JOB OFFER letter to use AC21 once you sent this info to USCIS to use AC21 your I-485 will be approved on recent job offer letter you dont need to go back to A after GC is approved . you can be on H1 with B or EAD and still can use AC21. H1 has nothing to do with GC, GC is for future job.do you know if one is qualified one can get GC with out LC or H1B???
That is something also I want to avoid.

That ain't true yeppo.

I believe as of today u r safe to use AC-21, if this is true then u can
forget ur 140 petioner for good and start working for new company.
