my wife recently landed herself a job as a university lecturer. she does have an EAD as she is a derivative applicant in my I-485 application, so she could start her employment right away.

the international office of the university, however, indicated that they would like to sponsor her for her own H-1, since "your status is dependent on your husband's, and IT is a volatile field right now." (surprise, surprise!)

so the question is, if her current status changes from H-4 & adjustee to H-1, does that mean that something changes with our current I-485 process as well? Do i need to advise the INS jurisdiction adjudicating our 485 of this change?

Not necessary...

Since h visa and adjustee status can co-exist without any conflicts this should not pose any interference with the 485 process.
In my opinion, you need not inform INS, as much as you dont voluntarily inform INS of your AC21 based job change. If INS is going to generate a RFE for this, it might even reject the H1. The adjustee status will serve as the safety net.

You seem to relish this :p

Jaxen has already clarified this. Just to add, H-1 is anyway dual intention (intent to immigrate) visa so you are not violating or concealing any of your intentions.

... that when i said "gurus", i meant exactly the two of you (i presume) gentlemen. yes, i also thought that this situation should not necessitate any communication with the INS; knowing you are on the same page clinches it for me.

do i seem to relish this? i guess that is because this whole immigration shebang is something we all could have done without... would have been nicer if GC's were handed out on silver platters.

since they are not, i might as well lie back an enjoy it (a certain pun intended ;-)

Thanks for the kind words, but I am sure we all miss Jim - the guru! I guess he is too busy with his practice.

Of course, everybody has the time crunch, but just a thought... wouldn't it be a good idea to make a special advisory panel of Rakesh Khanna, Jim Mils, and Jaxen for the issues which need the authentic answers?

i am glad jim's practice has taken off. he was really helpful to a lot of people when he frequented this forum.

a panel of volunteer experts is certainly a good idea. its format could be similar to allexperts.com, which has a panel on immigration law as well.

Not as much as I used to be but I'm around. I also get a fair amount of email from people in this forum.

It looks as if you guys have a pretty good handle on things though.
