Hi,

I and my wife were approved yesterday (10/31/01) at Baltimore INS after the interview and our passports got stamped.
The case is EB2, RIR, India. PD - 04/99, RD - 10/00, ND - 11/00, TD - 05/17/01, ID - 10/31/01.
We were interviewed by Officer F. The line of questioning as I recall now is as follows:
1. Take Oath
2. Show Passport, EAD, I-94 and Drivers License
3. Verify basic information for both (mother\'s name, father\'s name, date of birth, place of birth, date of last entry to US etc.)
4. Verify employment (Name of the company, nature of the job, description of what exactly are the job duties, place of work, previous employment, name of previous company etc.)
5. Verify Qualifications (Highest degree received, the field in which degree was received)
6. Verify marriage (these questions were primarily directed to my wife - date of marriage, place of marriage, proof of legit marriage like common bank accounts, common credit cards statement, common lease, same address on the license etc.)
7. Verify wife\'s status (my wife was on F1 for a year, current employment for my wife, nature of job, letter of employment. Although my wife applied through me, she was asked for current status. Since she is now working, so they did not ask for Affidavit of Support i.e. I-134. But this is my guess).
8. Show originals (we were asked to show some of the originals later in the interview. I did not have birth certificate, so I took two affidavits - one from my father and one from elder brother. Plus I had non-availability certificate. Unfortunately, my non-availability certificate did not have any seals or notarization ... yeah, the original one looked like fake!. But then she asked for my original 10th grade certificate which is also recognized as Birth Certificate in India. Somehow, she knew that and she accepted that as the birth certificate. My wife had birth certificate but the translation did not have her name. It just said \'baby girl\'. So we took another affidavit from her father. In addition, she asked for original pay stubs, last year\'s W2 and tax returns. We also presented my company\'s financial report.She asked for original letter of employment and current letter of employment. )
9. Closure - She said that everything looks fine, so she could stamp the passports there itself (there came a slight hitch since my wife\'s passport was \'professionally (sarcasm intended!)\' prepared by the authorities with smudged date of validity! So she was concerned if it was altered. But she used her descretion that it was okay. Sigh of relief!). Then she stamped our passports. Told us what we can do as Permanent Residents and that we should be receiving our cards in 8-10 months. She gave us an opportunity to ask us any questions. We asked about last name change after we get the GC. She said they won\'t issue a new GC with name change, but she could do it there itself. If we get new passports, either because of name change or because it expired, we could go back and get the new passport stamped at any time showing the old one.) Then she congratulated us and showed us the way out.

Hopefully, this should provide some information about level of documentation and line of questioning there. I will be happy to entertain any questions about our experience at the interview and I will still be visiting this board for some more time.

"original letter of employment and current letter of employment"... is this from the same company or did you change your job? Your wife took pay stubs from her company as well? Last question - how many proofs of marriage did they ask for? how many did you show?

Answer: I did not change the company. Both the letters are from the same company. The original letter of employment is the one that I got when I was offered the employment. The current letter is the one which they gave me after I got the interview notice stating that I am still employed there. I don\'t have the exact wordings here but I will post it soon.

My wife took one pay stub from her company. They did not ask for it in the required list of documents, but since we were claiming that she was working, we thought we might as well take one pay stub for her also.

Following is the list of items that we took for marriage:
1. Marriage certificate (original) and some photographs (the same one that we used for her H-4 earlier)
2. Joint bank account statements
3. Lease in both of our names (we forgot to make the copy, but she did not insist as she saw a copy of our common credit card while we were fumbling through our documents searching for the lease photocopy).
4. Common credit cards copy
5. Statement of common credit cards
6. Same address on the driver\'s license
7. Affidavit of support (I-134 notarized) showing my support for her. She did not look at this document.

My lawyers told me that basically for the marriage, they would like to show that we were legally married, and we share assets and liabilities together as a married couple. Therefore we took a document to show that we were legally married (i.e. the marriage certificate and photos), a document to show we share assets (bank statements with joint accounts), documents to show that we share liabilities (credit card copies, credit card statements, joint lease) and that we share address (driver\'s license). In addition, they want to see that your spouse will not become a public charge. So they look for I-134. Since we showed that my wife is working, they probably did not ask for I-134.

There is no specified dress code, although we saw many men wearing a Tie and many ladies in business dress. We personally thought that a professional look for both of us is not going to hurt us, especially because mine is Employment Based Category. So I wore a Tie with a Blazer (or Sports Jacket). My wife chose a business dress.

I too have the Birth Certificate problem

I have two affidavits ( father and mother ) ; I have a non availability certificate whuch is in the local language. It is
handwritten ( actually a printed one with blanks for filling up)
and does have some seals. I have got a translation done and notarized
in India. As you said the non availability cert does look like a
fake , even though it has the seals. Also it was torn out of a book
( of several forms I guess ) in a rough way so has some jagged edges
on one side with a few letters in the right side missing.

I hope these would not be a problem .

I also have the 10 th grade cert with the DOB on it , also
I have the letter from Indain embassy for DOB before 1970.

Do I have to get the non availability cert translated and notarized in USA too.
How did you do the translation - by yourself or through some one.

Birth Certificate and Non Availability Cert

I presented two notarized affidavits for myself (one written and notarized in India by local court on Five Rupee Stamp Paper and another one written and notarized in US on regular paper. Both from immediate family members who are elder to me). In addition, I presented my fake looking original Non-Availability Cert. Thankfully, my NAC was in English, so I did not have to do the translation (My wife\'s original birth certificate was in Hindi, torn from a book with zagged edges, and had original horoscope on the backside. We got a notarized translation for the birth certificate, and not the horoscope :). Unfortunately, the translators did not carry forward her name and simply wrote \'baby girl\'. So we got one notarized affidavit from her father with her name, which the officer accepted. As far as I know, you have to get the translation done by a professional service, but I may be grossly wrong. Mine was brokered through my lawyers, and they did the legwork for getting the translation done. I sent them the originals). She kept the original copy of my NAC with her.

However, she did hesitate to accept my NAC initially and asked us to go back to our government and ask for a proper NAC. We said that this is exactly what we had done. We told her that our government (local court) told us that we had to go to the hospital to get NAC and there is nothing they could do. So we corresponded with the hospital several times before they agreed to write it on a paper that they lost my records in a flood several years ago. But the paper they sent did not have any seals or notarization. We also told her that it is not a simple task to get anything like that from the government and that it has already been a very frustrating experience for us. This, by the way, is a true story. So she herself prompted us to produce our 10th grade certificate. This may not be the case for other countries but at least in India, that certificate is as good as a birth certificate and she knew that. Thankfully, she accepted it.

Obviously, there are no published guidelines that I could find about what exactly they will accept in lieu of Birth Certificate. But my lawyer told me that one NAC with two affidavits is good enough. 10th grade cert is a good backup, at least for people from India.
