Oct 2004 I-140/485 Finger Print Notice w/o I-140 approval

Hi Guys,

I regulary view this forum and it was very helpful. Below is information on my case. I just wanted to check if any of you guys are in a similar position.

I have filed for I-140/485 concurrent processing in Oct 2004. Yesterday, I received my Figure Print Notification. I have not received my I-140 approval yet and the LUD did not change on my I-485.

According to my lawyer, TSC is consistenly holding on to several I-140's that were filed concurrently filed until the I-485's are closer to approvals .

Also, according to my lawyer it does not make any difference if she calls and checks for the status of I-140.

Anybody else had similar experience ? Comments ?

I am in the same boat as you. I had an RFE om I-140(company financials). Actaully the attorney did submit the complete company financials but USCIS still asked(may be overlooked). Me and my wife got FP notices yesterday without any LUD on I-140/I-485.
 
When did you reply your RFE?

No approval yet
2nd FP- March 3,2005

Is USCIS is doing this for only october cases,
I am little confused, for other concurrent cases applied before and after october I noticed that they got FP before I-140 and after some days their I-140 got approved, I don't think your attorney is right because they cannot hold 140 cases
like that.

They asked me also for 02,03,04 and W-2 I send in yesterday, as i see its been 15 days for you already...what are they checking...

I also though they cannot hold I-140 due to AC21 portability. However according to my attorney, AC21 was never a "precise Law" and Services centers are generous in doing their interpretation.

Hopefully, the "FP -> I-140 approval" trend continues and I get my I-140 soon ... does not hurt to be an optimistic :p
 
We (3 of us) are also in the same boat as yours. We received RFE on 140 last week and yesterday we got the notification for FP. No changes online though ! (No changes to LUD).

Its a Good sign.

when did you submit your rfe and when did they receive it.

My I-140 also did not have the Priority Date. My lawyer said that it does not make any difference. .... so nothing to be concerned about.
