OCI Questions

hi,
My wife just became a US Citizen. She was formerely on an Indian Passport. I am Indian. My Kids are US born citizens. My eldest is on a PIO. My question is

1. Can my wife apply for OCI?
2. Can my eldest on PIO upgrade to OCI?
3. Can my youngest apply for OCI?

Unless there is an urgency to upgrade PIO to OCI, I would say wait.
The reason you would upgrade is if the kid was going to live in India long term as you avoid FRRO / renewal work (if any).
The other reason you could upgrade is if the card was going to expire and you were expected to go through the renewal process again.
The reason to delay upgrading is because the PM promised merging of PIO and OCI soon ... it might take years, but it might work for you depending on your situation.

I don't believe what the PM said and he may have said to please the NRI who went to Parvasi Bhartia Diwas.Even if they want to Merge PIO with OCI nothing was stated how they are going to do that and when they will do that. PM alone cant do that in few months and Government of India is busy facing Many Scams. 98% Miniters,MP, MLA are all corrupt. why nobody including PM or others said anything why now the Indian Consulates suddenly started collection of $ 175 for Cancellation of Indian passports and started giving a paper called Surrender Certificate? is that donation on the name of Surrender Certificate? what they have done or doing to Bangladeshi who daily enter India and then get Ration Card by paying Rupees 500 Bribe and then Get driving license by paying Bribe and then get PAN card and then Indian passport? Do they think that one cant get Indian passport again if one wants? One can get Birth certificate made with different date of Birth and place of Birth by paying bribe Or can attach affidavit for new date of Birth or place of birth and can get Indian passport again. Those who got US Citizenship knew that once they have got US citizenship they are not going to use Indian passport as it became invalid automatically as Indian constitution don't allow Dual Citizenship.

They collected $195 from me and never sent my Surrender Certificate. Do not know what to do now.
So they are not even issuing that paper to many of us even after charging the amount.

Alright, the OP is advised to check his/her blood pressure and decide accordingly ...

I am talking about practicality. If the PIO card does not expire for next 5 years, and if the child does not need to live in India, it is wasted effort to upgrade to OCI.
However, since you (the OP) is doing it for others, I see no harm in adding one more application to the courier package, but note that the process, documentation and fees for upgrade are different from normal OCI processing. Since we have so much trust in Indian babus (rightly so), do remember that these might get to different babus and might be processed at different speeds, might be tracked differently and you might get status for one but not the other ... causing another incidence of high blood pressure.

Yes.

My apologies for the confusion. You are correct and your children would be eligible for OCI as you correctly pointed out. I remember what the deal was now. Minor children cannot apply for OCI if:

1. If both parents are Indian citizens --OR--
2. If one parent is an Indian citizen and the other parent is not an Indian citizen but is not eligible for OCI himself/herself.
 
Not a problem Sir. Do you know what defines a minor child? under 2,3,4 etc

I have made the assumption that a minor child is defined a child younger that 18 years old but it is fuzzy and not clearly defined anywhere on the CGI websites as far as I know. The voting age in India is 18 and so maybe that might be a pointer? I think they assume that parents would apply for OCI when their children are clearly still young children which we know is not always the case.
