OCI for minor child with 1 parent of indian orgin (other parent is not of indian origin)

Hello,

I am getting ready to apply for an OCI card for my son who is 5 months old and I wanted to check if he is eligible for an OCI.

I was born in India in the early 70s and had Indian citizenship till 2005 when I naturalized as a US citizen. I obtained my OCI card in 2006.

My wife is a US Citizen. She is not of Indian origin and has never been an Indian citizen.

My son was born in the US and has a US birth certificate and passport. He is not an Indian citizen.

Given the above, is my son eligible for OCI? Any thoughts on how to find out for sure, before applying (Travista Outsourcing doesn't seem to have pre-application human customer support).

PS: I have looked at the OCI requirements at CGISF and Travista Outsourcing. While the listed requirements there do not exclude my son from an OCI, they don't explicitly cover the case of a minor with one parent of Indian origin and another who is of non-Indian-origin. Hence the question above.
 
Yes, he is eligible based on you being someone who once held Indian citizenship. Go ahead and file for his OCI.
Your wife will be eligible for a PIO card if you so desire.
 
Yes your son is indeed eligible because my son was in the exact same scenario as your son and he got his OCI. When you do apply for his OCI you still will need to provide documentation of your wife. What I did was clearly write a statement (in addition to the self attestation statement) on all of my wife's passport copies, etc that my wife was the mother of my son and that she has never held Indian citizenship or passport. Now that we have had another son recently, I'll be going through all the exciting adventures of applying for this new fella's OCI :)
