Hi,

I think raising fees on applications is fair if the
service provided matches the intention of increasing
the service.

My application for Employment Authorization Document
(Form-I765) took almost 6 months for processing and
was approved on May 27th,2003 (WAC-03-******). I
never received the approval document nor the card.
After repeatedly pursuing with the USCIS's National
Customer Service (NSC), i was told nothing can be done
except re-applying for the replacement of EAD again.
So for the initial application $120 was wasted.

Now, i payed the fees of $120 again and applied on
December 11,2003 (WAC-04-*******). It says it takes
120 days for processig. I got worried that my
replacement EAD will be invalid afterall as the time
it is taking to process these cases is now 6-8 months.

I later found from someother representative at NSC
that the validity dates of the EAD card will be same
as the initial application even if the replacement EAD
comes through and suggested i apply for a fresh EAD
stating the sequence of events in a cover letter. That
means another $120 down the drain.

Now with fees increase, i will have to pay more
($120+more) to get one EAD card to me. That is
cheating/fraud/unfair whatever you call it. I will NOT
support if the service is what i have faced.

Please consider the fact that money doesn't grow on
trees for people seeking immigration and we too have
kids born here in America and we have to look ahead
for their future too.

Friends,

We have done so many email campaigns, petitions, representations, lawsuits. While they are all building blocks for our effort to bring processing timelines to an acceptable range, i still think a protest against USCIS at their office or someplace should also be taken up.

A protest doesn't and shouldn't necessary mean irratic behavior but an attempt to get our point across in front of irrational people/organizations...

I know this is not the thread to post suggestions here but please let me know what your thoughts are.....

I think this is a good idea but we need a to time it. One good time is when the Law Suit goes to the Court. As far as I know thats not far and we should get correct dates from Rajiv.

We should protest in front of the Court and at CSC offices at the same time. We should be able to mobilise enough people.

One whoes I-485 application for Adjustment Of Status (AOS) is pending
can apply I-765 for Employment Authorization Document (EAD)
and I-131 for Advance Parole (AP),
but the validity term of EAD and AP is only one year,
so I-485 applicant has to apply I-765 and I-131 again and again every year,
usually more than three times due to the current I-485 backlog.

If USCIS increases fees of I-765 and I-131,
at the same time or before that,
USCIS should extend the validity term of EAD and AP
until AOS (I-485) is adjudicated,
including EADs and APs that have been already issued
even if already expired.
Of course, it doesn't matter when USCIS eliminates the I-485 backlog.

Actually, USCIS extended the validity term of EAD for TPS El Salvador
last year without amendment of INA.

Please take it into consideration.

I went sightseeing in CSC in late December,
but I think it is not a good place for protest.
Nobody may pay attention to us.
 
Court may be a better place. With enough people protesting in front of court, we'll surely bring attention to media.
 
As said above, we have sent emails and faxes which have yet to bring significant improvement. A well-organized protest in front of courthouse will empower us to attract media during the year of election.

Kahsmir, you can consider it your next plan after Ocean project.

3 times renewed my EAD and travel documents {3X120, 3X120 Plus lawyer fees and fedex fee } just because our AOS is pending for long {since June, 2002}.why don't BCIS process I-485 fast that will avoids EAD, travel documnets renewals.

Once BCIS starts processing 485 instead of putting us in loop to get EAD then AP and renewals, Ofcourse it makes more revenue for BCIS for without proper service/no service. just call yourself NSC 1-800 phone number you will be know how good they are in customer service. I don't want to pay single penny extra for this type bad service from BCIS, this is not proper.

Even if fees will be increased, the USCIS cannot eliminate the backlog by 9/30/2006.
How about increase $1,000 or $10,000, and eliminate the backlog by 10/31/2004 ?

I dont think many would be willing to fly to Wash DC for this. I would rather contribute couple hundreds to a fund for hiring a professional lobbiest.

This cameup couple of times earlier but didnt fly.
