Obtaining A Green Card Through My Step-Dad...

Hi,

So we've been trying to find answers to our situation... I know that for immigration purposes, I am the child of a USC as my parents married before I was 18, and I am still an "unmarried child under the age of 21" Although I turn 21 in late September. My step-dad has lived here for almost 12 years, and has been married to my Mum for 10 years.

The issue/questions we have though is that my step-dad lives here in Australia, and I'm the one who wants to move to the US. Can he still petition for me and sponsor me, even though he lives here? He has a place there that we go back to every year or second year at Christmas as it's two houses up from his daughters place. So I would have a place to live for awhile/until need be if that helps for the sponsoring of me.


I know we would be approved for the I-130, as everything on that is simple. But it's the I-864 Affadavit of Support that will be the deciding factor due to him living here, not there..


He rang the US Embassy in Chicago and the guy he spoked to seemed to think that it's not an issue that he lives abroad and that we should apply and go for it, however he wasn't very sure of himself and seemed to be reading off of the website and also said he can't be 100% sure...

Any help?
