Oath Ceremony Postponed due to Traffic Violation

Hi,

I received a traffic citation two weeks before my oath ceremony. At the oath ceremony I was told that I could not attend the oath and that I would receive a new appointment by mail.

A hearing is yet to be set, a plea of not guily has been entered.

What happens now?
 
They probably did not let you tke your oath because the case was not solved. Try to resolve it asap and make infopass with the actual payment and and court deposition and you will be fine, i think.

Was the violation alcohol or drug related?
 
You will be fine, once you bring court dispositiuon. Just make sure you handle it properly and pay the fine

I think he meant he did not cause any "wrecks". The charge was based on a failure to cause such wrecks. Maybe this is from some Mad Max jurisdiction where insane driving is actually encouraged - Alabama?:)

Reckless driving n. operation of an automobile in a dangerous manner under the circumstances, including speeding (or going too fast for the conditions, even though within the posted speed limit), driving after drinking (but not drunk), having too many passengers in the car, cutting in and out of traffic, failing to yield to other vehicles, and other negligent acts. It is a misdemeanor crime. A "wet reckless" is a plea in a drunk driving prosecution allowed to lessen the penalty when the blood alcohol level is close to the minimum allowed by law

Sometimes handed out for speeding >20mph over the posted limit.
 
Funny. I actually thought it was written wreckless. I was wondering how you could be punished for not causing any wrecks... :p

I think my attorney wants to enter a no contest plea.

I was driving down my road, and I pulled up on the hand brake because I thought my pedal brake wasn't working properly. My back wheels locked for a second or two, I was going at 35 miles an hour, and the car rocked a little from side to side. By the time I had brought the hand brake back down, I was hearing and seeing the darn police light behind me (they were behind me driving with their front beams off).
 
What was the speed limit at the point this occured. If this is all there was, I will seriously consider contesting the ticket. There is no need to let things like that go unto your driving record, naturalization or not. If my pedal breaks are not working, I will certainly attempt to bring the car to a stop with my hand brakes
 
25 Miles or above

I believe anything over 25 miles per hour over the speed limit is classified as reckless

It was dark and the trooper had no lights on his vehicle? Hmmm, sounds like he might have been following you. I wonder if proper police procedure says he can drive at night with no lights???? Sounds reckless to me....

Any possibility you could get a mechanics report that you did indeed have a (now fixed) problem with your brakes? You're going to need something to take to court other than your word against the trooper.
