My experiences with O visa ...

An overview of my approach to O visa:

  . I have a masters degree in computer science with experience of 8 years.
  . I have expertise in the field of Large Scale Distributed Computing for Internet Telephony.
  . I have three publications and co-author of a specification at Java Community process.
  . My company is based at NJ and Texas, so we applied at both the centres.
  . I have opted for premium processing by paying 1000$ extra and got the approval in 3 days.
  . I got an approval from Texas and so withdrew the other pettition, because last action law states
    that the last pettition decision is final.
  . I was on H1B visa prior to obtaining an O visa.
  . I work for a small company working on good technology.

  Regarding chances, you should definitely give it a shot.
  You have to find a good lawyer to present the case and you should be very pro-active.
  The attorney\'s are expensive as I had to pay 10000$ for this process.
 
  Once you make this decision, evaluate the following criteria.

  1) How co-operative is your employer?
  2) Is your employer a fortune 500 company?
     Provide as much information about the company as you can. For a small company it helps.
  3) I had 10 reference letters and INS expects around 5.
     Important thing to note about letters
      geographical distribution of the letters.(e.g., 2 US, 2 Europe, 1 India etc.,).
      should be strongly written stating that you have extrodinary ability.
      should have acclaim ( praise, compliments and acheivements )
      should be able to translate every acheivement to something tangible.
       e.g., a product you worked won an award, service that you built solved a specific problem
       in the industry or project you worked made a difference to your company etc.
      quotes from the letter are used in pettion sections, so get the following content in letters
        their expertise, bio and acheivements
        praise of your expertise
        statements that translate your acheivements
        statements that you judged and reviewed others work (helped hiring, reviwed design etc)
        strongly recommending your case for visa
      get letters from people in old projects, this demonstrates sustained acclaim.
      geographical spread provides national and international repute.
      get letters from people who are known in the field of your expertise but did not work together.
      get only one letter from the place you currently work as they have vested interest.
  4) There is a peer advisory opinion which should be from a professor or a professional who is not
     related to you at work. This basically states his expertise in the field to judge you, his
     assessment of the position and responsibilities you are currently holding in the company.
  5) A decent salary should be posted for you as this is a criteria to show that you are paid more
     than peers in your industry.
  6) awards, publications, papers are definitely a plus
  7) affiliations to professional organizations are good.
  8) A letter from your management stating that you are important and the direct consequence of not
     having you in terms of project slides, revenues etc.

can a J-1 visa holder apply for O visa?

hi,
i have a friend who holds a J-1 visa and is working on his post doctor in boi-science. now he is kind of thinking of shifting to the industries for a better pay and getting his green card. but again he is now on his J-1 visa.
question is:
- can he apply for an O visa, after or before he gets offer?
- how long would it take in different service center?
- how come you paid so much for the case? can you give the details?
- after he gets his O visa can he then apply for his green card? at which stage must he get his J-1 waive letter from his country?
if he can then it is very worthy to give a shot. the documents you listed can be re-used for his GC application.

Eligible for O1?

Hi Iam right now holding an H1-B Visa from a fortune 500 company..
I would like to know the advantage of switching to O visa?
I have been in USA for 5 yrs.. and havent filed for a GC. As I heard, people switch to O visa, after completing their 6 year term on H1-B! is that right?

who was your attorney please? fees? did you also apply for EB/NIW/RIR at the same time? usually are the employers willing to pay for the legal expense for O visa filing?(since it may or may not be approved)

1. He can apply for O1 after he gets a job offer and his sponsoring company has to file for him.
 
2. It takes from 3 days to few months. If you opt for premium processing, then it will be within 15 days at all service centers.

3. He has to obtain J1 waiver for obtaining green card. He can apply for I-140 without the J1 waiver, but for filing I-485, J1 waiver is required.
 
Guys, I don't understand the procedure of getting an O1 visa completely. Can you please answer my questions?
Let's assume that there is a company willing to hire a specialist. It gives this specialist an offer. Do they file for an O1 visa too? Or specialist should file for O1 visa by him/herself? How long does it take to get O1 visa approved?
As I understood, in case of specialist with J1-2HRR, s/he must leave US and get the visa stamped in US consulate or embassy outside of the USA. Correct?

Your company needs to file for the O-1. You can't.

You need the stamp or you have to file for adjustment of status. J1/2HRR is not a problem for O-1. You get the stamp even if the HRR still applies. BUT, you can adjust to H or GC later on (until the HRR is served or waived).

Thanks for your very informative response.
It looks that I have to go back home to fulfill this 2HRR. It is just pity-- you advance the American science for 5 years, but as reward you get a return ticket. 2 years is going to put a huge gap in my resume.

I have 7 published papers in the energy, oil and gas field, working in a renowned nationasl lab in the US for about 2 years now. Just filed three patents, 2 first author papers soon to be communicated, and 4-5 second author papers. Worked for a year with a renowned researcher in my field in Europe too. Have around 20 + conference presentations and a book chapter. I have 8 recommendation letters from renowned people from my field to support my petition. A fortune 500 company has hired me and wishes to petition O1 for me. What are my chances?

Travel permission

Hello,

My O-1 is approved. I wonder if anyone knows how I can get a travel permission to outside the US. I need to go to Canada for 2 days and back immediately. I have only a single-entry visa stamp on my passport (based on J-1 visa when I entered to the US). Now it is expired and not valid anymore.

I called the US embassy in Canada, They said to issue a new visa stamp it may takes couple of weeks or longer. I can not stay in Canada that long I will lose my job and so my O-1 .

I really appreciate any help in this regard.
