Hi guys, (derivative asylee)
The laws that govern derivatives asylees are quite obscure. Particularly what happens when a derivative asylee divorces the principal? I have made numerous researches to understand my situation, but nobody could help me, even immigration officers at the local offices and lawyers could not understand. And my Google searches turned up zero cases relating to the issues pertaining Nunc Pron Tunc. Now that I have been through, and there are a couple of other friends on this forum who face the same issue I have decided to dedicated this thread for Nunc Pro Tunc issues. The goal here is to guide in the future fellow asylees who experience the same issues.

Please post/share your experience if you are derivative asylee who divorced the principal applicant. Please do not post questions pertaining to causes and the nature of the divorce that caused the problem.

On Friday Jan. 06, 2006, with an infopass appointment, I went to the local office in my city. It was not that busy, after 6 people my number was called upon. The Officer I met was an old chinese lady. she was nice. she took my papers and she scanned one of them on her computer. She said "It should not take you this long for you to become a visa availible". she was not understanding my nucn pro tunc thing. I explained to her about my situation. and after little bit of search, she told me that they will schedule an interview for me. according to the information on her computer, she told me that they did not schedule an interview yet, but they will schedule one soon. she aslo said that they have done something to my case, but she could not tell what that was. Her advise: Wait for the interview. I asked her where the interview take place. her answer: look at the interview paper carefylly. She told me that normally the interview does not happen the local office. normally she said they will tell you on the paper. It could be in a hotel. nobody knows..... :D Another issue I asked was what the procedure from here would be she said, "First, they will interview you". After that you must start the greend application from anew". :D which mean new application with new notice date. Just new application as you would do after one year of grant asylum................................................................... :D Share your experiences.......
 
Guys, as I have mentioned above, my case was transferred to San Francisco Office for asylum interview. The transfer date was Dec. 8, 2005. Today on 11 Jan, 2006 I got reciept acknowledgement from San Francisco Asylum Office. It is language sounded this away.

We are sending you this notice to let you know that we have recieved your asylum application (form number). You application is pending this office as of 17 May, 2000. We will send you an interview notice informing you of the place, and date of your interview. We will conduct an interview of your casw. While your case is pending with, if you want to travel you must obtain an advance parole from the office that has jurisdiction over your case. You must present evidence of relationship for all individuals you claimed on your application. If you move you must inform our office of your new address within ten days.

Now their receipt date is Jan. 6, so I am expectiong to get an interview within 6 weeks.
This information is for deravative asylee who divorced the primary applicant and has to file nunc pro tunc. I will be recording my situation every step of its way to guide future deravatives............
 
I have got 14 days fingerprint and photo notice Yesterday. I went to the SC and I was fingerprintedd and photographed. Waiting background chech and FBI clearance and then interview. :)
