NUNC PRO TUNC question

Hi everyone,

I've read what has been posted so far about nunc pro tunc cases and I'm still a bit confused.

I got derivative asylum under my mother and I was 16 when I got the asylum. My I-94 says "Asylum granted indefinitely". I applied to adjust my status as a permanent resident back in 2001 and by then I was already 23. I went through the whole process for the green card - sending additional information, biometrics, etc and just when I thought the whole thing was coming to an end, I received a notice saying I cannot adjust status and have to file a nunc pro tunc asylum application. Based on what I've read here on the forum, it seems like a straight forward process but when I spoke to an immigration officer, she made it seem like I have to apply from scratch i.e. I have to prove why I'll be persecuted if I were to go back to my country. I pretty much feel like I'll be under deportation proceedings soon.

Now my question is, when I do the nunc pro tunc application does it mean I'm just applying for asylum and I have to do the whole green card application over again (which means another 5 year wait)? Should I get an immigration lawyer to deal with all of this?

Thanks and please help!!

It is a formality only (thought it takes time). You do not need to reapply from scratch.

And do not expect the 800 customer service people to understand this process because it is too esoteric.
