All NSC filers,

Eventhough Rupnet or Immigrationportal does not show any approvals happened for the 485 Applications filed in Feb 2002, I collected the following LIN which are all filed during Feb 2002 got approved as per the on line. How do you know that these cases were filed during Feb 02? It might be the case that all the above LIN nos are for CP.

FYI

CP cases have nothing to with service centers (they are not "Adjustment of Status" cases, obviously), so they won't have LIN (or EAC/WAC) numbers.

as a matter of fact, CP cases are not even processed by the dept. of homeland security. they fall under the jurisdiction of the state department.

User Dear: the LIN no. range indicates that all these cases had notice dates in the period between 114th to 124th work day beginning Sep. 01, 2001, which makes it likely that they were indeed processed for fee collection by the INS during Feb. 2002. Regarding your second question, CP cases do not have an I-485 associated with them.

Jogil, are the approvals posted below a result of running a script on the INS website (many such scripts seem to be in circulation) or do the LIN numbers belong to a group of people that you know.

If it is the former, this forum has been aware for some time of the fact that generally 50-60 percent of LIN numbers return an 'approved' message. I am a relatively recent arrival on this board and have been aware of this apparent anomaly from user immigrationusa's posts (there may be others). One can speculate as to how this may have come about, but in my experience, it is not usually a pointer to the current status of Nebraska's employment-based AOS adjudication activity.

If on the other hand, the LIN numbers belong to people you know, then it is perhaps time to get our hopes up.

NSC rocks....maybe for applicants from countries that have not been 'flagged' by BCIS.

Yes they are!

I checked the last number posted here at the INS website. It is indeed a 485 case, approved in March/03. But we don't know the category.. I have heard from a friend of mine that someone filed in April/2002 (EB3)got the approval. Isn't it strange?

nebs, please try to find detail about

whose April case got approved? special case or some ordinary case? it will be interesting to know.

Nebs, is that April 02 case from 'flagged' or 'non-flagged' country?

Flagged goes beyond SR countries.........

Frodo,

It certainly appears that for some reason, applications from certain countries are processed slower than others. One can even make a reasonable non-exhaustive guess as to which countries are put in the slow lane. However, to attribute this speed differential to the so-called flagging process (as opposed to some other quota based system), one would need some understanding of which countries are flagged. Is there a place of the web which provides reliable information on which countries are flagged and the nature of such flagging?

BCIS will officially deny from now until eternity that there are any flagged countries. Logically, NSEERs impacted countries are definitely on the list. From what we’re reading on the forum India may be on it as well. Some posters reported minor harassment by customs or BCIS agents while entering the country from Mexico. I'm not sure about the quota though for employment based cases which applies to the majority of this forums users. I thought all priority dates were current. Is this correct?
Rgds,
sadiq

All priority dates, as you say, are current. However, priority dates control the application process, not necessarily the adjudication process (by which I mean the point at which a decision is made by the INS) although I believe the continued availability of a priority number at the time of adjudication is a necessity for adjudication to occur.

I would be surprised if the two speed adjudication was found to be a recent phenomenon, resulting from the heightened security considerations stemming from 9/11. I am inclined to think that such a discrepancy existed even before the events of 9/11, although I do not have any ready proof to offer. Maybe there are some old hands in this forum that can comment.

It makes no sense to believe that just by increasing the time immigrants from some countries spend in the I-485 stage, the process is made more secure, unless that time is being used to carry out effective background verifications of the applicants including in their home countries. To the best of my knowledge this is not the objective of the delay. Even if attempted, this is, in my opinion, impossible to achieve given the dilapidated and fragmented record-keeping systems that exist in many of the immigrants' home countries. Given that the FBI carries out security checks on individuals in the US in days, if not hours, there has got to be a different reason for the two speed process.

Which brings me back to my hypothesis: There is some other internal, undisclosed quota mechanism that is at work.

Sankrityayan,

As Sadiq points out, the BCIS never officially has made it public its 'flagged' list of countries (would it ever?). Based on what folks have been sharing here, and from information gleaned from immigration-law.com that there's additional scrutiny on non-immigrant visas applications from individuals (from countries listed below) who work in certain high tech/bio reseach areas, it appears that the so called 'flagged' countries include India, China, Russia, and Israel.

Cheers.
