My I-140 (Eb1-OR) filed on 2/27/04 in NSC was approved on 4/11/05. I-485 was filed on 4/28/04 but still waiting.
The I-140 processing in NSC definitely becomes faster because my friend got his I-140(Eb1-OR too) approved in early March but he filed in July 2003.

Hope your I-140s will be approved soon.

EB1 vs EB3

Congrats.

How come EB1 gets approved later than EB3 or even EB4.

What specific advantage one gets by filing EB1?

Thanks

EBhola

Congrats!!!

That is indeed good news for all of us NSC ORs. Could you please share some more case details, qualifications etc.

Thanks.

Advantages are

1) No need for labor. Directly apply for 1-140
2) Extremely unlikely that EB1 will ever retrogress

advantage of Eb1

Eb1 doesn't need to file labor which can save quite a lot of time. But the I-140 processing for Eb1 may be the slowest among all of the catagories, a least in NSC. Overall, Eb1 can be faster than Eb2 or Eb3 in theory but it has more chance to be denied too.

{....}

But labor takes just 2-3 months in most cases ..
So U are ready to wait for 2 year more than EB3 or EB4 for Ur I-140 ..
Does not make a smart choice though...

Yes -- U may not get retrogressed... thats one advantage...

my qualification

I have Ph.D in EE and works in a big company in the same research area as my Ph.D.
1. ~15 journal papers with ~50 citations
2. 9 reference letters: 3 from current company, 4 from my Ph.D. University, 2 from industry (actually my former group member in school). So my reference letters are not strong because all of them came from the people who know me.
3. no prize and important membership.
4. ~ 5 years of research experience including graduate school

Overall, my qualication is not very strong but should be average, I guess.
Good luck to you all.

mine too... 2 years.. !! people who have faced longer wait times in labor will understand.. how painful it is to wait at every particular stage !!

2 to 3 months. LOL
Labour approval in 2 to 3 months may be true in the cases where the whole population of that state put together is less than the number of prospective immigrant population filing from a state like NY or NJ.
Just kidding.

My Labour approval took 2 years ( 1year state (MI) + 1year federal (chi) )

3 years for labor? lucky you !!!

I have been waiting for labor since 2000, summer. My company can not file our labor because layoffs. We are still waiting for PERM, this is my 5 years to wait.

Dec, 2003, I hired a private lawyer and filed EB1 (OR). Thanks God, I get I140 approved last month, while my collegues are still waiting for Labor filing for the 5th year.
