Hi All,
Thank God Almighty!!
Our I-485 cases for me & my wife are approved on my birthday - Nov 23

Dates:
Both I-485 Approved - Nov 23 2004
I-140 Approval - Oct 05 2004
Both FP - June 8th 2004
I-485 - RD - Dec 24 2003 ; ND- Jan 2 2004
I-140- ND and RD- Sep 18 2003
Category - EB3
Service centre: NSC

I have following question:
My wife is in abroad now. Her advance parole(AP) also approved
when she is in abroad. I mailed the AP to her. Can she come back safely using that advance parole for her Green Card stamping?

now NSC also can tell everybody (also senators) they did approvals on 04 cases as VCS and CSC did, but how about huge 02,03 cases ...

Congrats!!!. Didn't your wife have valid advance parole before leaving US ? If she is on H4 or her previous advance parole is still valid she may not have any problem but if she is trying to enter the country with the one recently approved while she is out of the country, please check with your attorney.

Sorry, I honestly dont know the answer for your question. But if she has a valid AP she can come back on AP.

She has valid H4 till jan end 2005. But she is planning to come back
during Apr 2005 after her sister's wedding .Also We applied her 1st Adv parole before she left in july 2004.
and it got approved last month(oct 04) when she is abroad.

I will check with attorney .

For an AP to be valid it must be applied and approved before a person departs US. Looks like in your wifes case this was not the case. Now since her H4 is till Jan 2005. She can use her H4 to enter. Although many will argue H4 is invalidated once 485 approves, but from experince and peoples discussion I can tell you she will be allowed ion the H4.

On returning, she can get her passport stamped with the I-551 stamp and then return to attend the wedding. Although a sisters wedding is a big occasion and all that, but think it is much more important that she be able to enter US and join her husband. So I will suggest that you spend the extra 2-3 K and get her back to US before her H4 expires, and do the GC stamping.
