JANUARY ND Cases !!
Folks,
Couple of us having ND from January are still waiting on EAD approvals. I have updated the list with known info on EAC and couple of approvals that were not put together into this list earlier. PLEASE update the list if there are any approvals lately (From Jan ND only....may be Dec).
Also noticed, from January tracker, cases with January MD and February ND also got approvals. It appears to be the Phone AVM is updated more frequently than online. If any of you curious you could check it at (802) 527-4913. This number can also be found at online status page :- Vermont Service Center (802) 527-4913

Should i call the VSC
Guys,
I had applied concurrently for the 140/485/EAD/AP at the end of november for myself and my wife.
I have a receipt date/ notice date of Dec 9 for all the apps.
We have received the EAD and AP's too.
We were scheduled and completed FP on Jan 30.
I haven't seen any updates on my 485 case online or through the phone system about my FP results.
Do you think this is just normal or should i call and talk to a IIO at VSC.

finally after long waiting MY EAD card has arrived.. I was suprised to see it when I open my mail box today...It was nice to see card.....There is small entwine here...I got just my card not my wife's..I am hoping her card soon (may be in next mail).....!!!!

Hi Sanga/Dependent,
I saw threads for concurrent filing for each month of Jan/Feb/March under vermont 140 thread..
I have taken the liberty of getting all the data ( so far!) into this spread sheet and request all of you to update and maintain this spreadsheet with other details as well.
As a sugestion we all can maintain just one thread for the latest updates on the vermont concurrent filing. Hope this will ease the search for 140/485/concurrent filing information for VSC.
If you all agree then lets get started and start updating the information in the spread sheet. Once the category and maling date column is full we'll sort the data by mailing date and everyone in this forum (and future members as well) will have a better understading of the timelines and can follow up their indivudual attorney in right time !!
I am certain it will help a lot of folks out there like me whose attorneys are not very supportive !!

i called the IIO at VSC about my case , 485 status not updated even after finger printing completed since 01/30.
the answer is DON'T WORRY. the reason being even if you have it updated it does not matter because we will pretty much have to do it again becuase these results would be void in a year and there is no chance of our 485's being completed in a year.
so guys take it easy and hope your 140's are done so u can use portability if you need just in case.

There is a slight mistake in the spreadsheet. The EAD approval dates for the last few names are mismatched.

Hi All,
We ( me and my spouse) have received EAD cards on March 28th and they were approved on March 20th.

I-140 Substitution issues
I filed my I-140 after substituting with some one else's labour. The receipt date is Nov 5 2002. I want to file for my I-485 now. Do we get EAD only after I-140 is approved??
Also what are the common problems/Queries encountered while substituting labour??

Thanks for your info on EAD at local office looks like my wife's card is on the way so I may not need to go to local office to get it..And also I advice you not to rush up there as I ve seen latey quite a few approvals of our folks, so u too might get soon..problem with the intrim card is they issue for only six months....so i think its worth waiting for few more days.....

i had checked my online status and it says that they have mailed me a letter asking for more evidence regarding EAD/AP on 26th march. havent yet received any letters from INS.
has anyone faced a same situation? what could they want more as evidence??
also they letter that they are sending will it come to me or my attorney???

Please download the excel file and edit your information. Save it on your desktop as UPDATE.xls
Then post your reply to this thread and click on "Browse" in the "Attach file" row and upload the UPDATE.xls

PLEASE HELP!!! EAD VS H1B-7th year

If a person on an H1B status has applied for I-140/I-485 concurrently and is waiting for their approval. In the meantime, the EAD and Advanced Parole are approved. If the time remaining in the six year limit of H1B is less than six months, is it better to use the EAD or remain on H1B status and file for the seventh year extension.
Also, if one wants to “use” the EAD how can they notify the INS (BCIS) to stop the clock on their H1B?
Can this remaining time (about 6 months) of the H1B be used in case the I-140 or I-485 are not approved for any reason? Is this considered to be a “new” H1B application and is it subject to the H1B yearly quota? What will be the status of the person while this “new” H1B application is pending?

I will be travelling to India on April 14th. My Question is do i need to get my H1 stamped in India or can i come on EAD/AP. I guess once i use EAD/AP my H1 is no longer valid. I will be changing the company in July. so i would really appreciate if anyone can shed some light on this.

what I read on this forum a while ago is that your H1B will still be valid even if you use EAD/AP, as long as you are with the same employer, but if you change the employer, then will have to get new H1b or work on EAD. hope this helps.

You have two choices to make:
1. Go to U.S. counsulate and get your Passport stamped with the New Visa valid date.
2. Don't worry about your stamping and just use your AP to enter back.
Advantage of using above option1: You will be still under H1 and if by any chance, something happens to your GC process, you still have valid status.Again, you need to see how much time is left on your H1, if it is close to 6 years, you are better off using Advance Parole.
Disadvantage of using option 1: You have to again spend more money and time for visa stamping.
Decision is yours and Good luck.

You both always give good suggestions and good information which is helpful for all of us , Can you please give me the details of Interim EAD , What are advantages and disadvantages of taking it , Do we loose our EAD which is now processing if we take the interim EAD from local INS office .
And the 90 days period is 90 business days ?

EAD/H1, which one should be renewed ?
BY next Feburuary my H1 will meet its first 3 year limit and can be renewed for another 3 years. By next March my EAD will exprie (got it this month). So I am wondering ---
Do I need to renew one of them or both ? Currently there are two different opinions I have heard ---
1. renew both od them, for the safety reason.
2. you can only renew EAD or H1, you CAN't renew both of them. So you better renew EAD as it is more powerful and can be used everywhere else. (I doubt this "CAN't renew both" statement)
Does anybody have any insight or experience to share ? Do you know any of your friends/colleagues do this ?

BY next Feburuary my H1 will meet its first 3 year limit and can be renewed for another 3 years. By next March my EAD will exprie (got it this month). So I am wondering ---
Do I need to renew one of them or both ? Currently there are two different opinions I have heard ---
1. renew both od them, for the safety reason.
2. you can only renew EAD or H1, you CAN't renew both of them. So you better renew EAD as it is more powerful and can be used everywhere else. (I doubt this "CAN't renew both" statement)
Does anybody have any insight or experience to share ? Do you know any of your friends/colleagues do this ?

According to 'doctrine of dual intent' you can use your AP with your H1B (Check out Sheela Murthy's website> murthy.com). You need to have approved H1B from INS to get a VISA stamped (I assume that either you have 3 more years on your H1B or you are doing the 7th year extension)...However if you use your EAD, you will be able to use H1B in limited cases (check with your lawyer).
Since you are changing companies in July, if your I-140/I-485 application is more than 180 days, you can simply use your EAD based on AC21 to change to a job with similar job description and salary.
Please check with your lawyer before making any final decisions.

Once you get Interim EAD from the Local INS office, your regular EAD application will be stopped as the local INS informs the INS service center that you have been already issued an EAD. And the 90 days is calender days from the Notice date of EAD application, not business days.
Earlier we can file EAD only after getting the I-140 approval, but now becasue of concurrent filling of applications, I am not sure how the local INS office is treating EAD pending cases. Check with your laywer as they have upto date info.
