I am eligible for AC21 and on bench for one month and not paid. I am still on H1b, legally till how many days on H1B can anyone be without paid even in I-485(AOS) stage. Is it good to leave this current employer and switch to new on AC21, can my GC sponsored employer revoke my I-140-.Please someone help me.

As far as I know you can not be on H1B and not get paid. DO you have EAD? When you want to transfer your H1b USCIS will ask for your paystubs. Can you go back on payroll?

I say talk to an atty.

If you're not being paid, you're in violation of your H-1 status. Your I-485 will keep you legal, but the H-1 is likely toast.

If you're not being paid and may not be in the future, AC21 is your best shot.

The question should be:

If my GC sponsored employer revokes my I-140, will it have effect on me leaving this current employer and switching to new on AC21 and why?
